    Thank you. Yes, true. I only found out about HPI check 1 year after. And with the other things - I guess I was just stupid.
    On the positive note, I now know what to check when buying a car, never trust, and I've learnt how to drive :-)

    What did the dealer fail it on? That might have some bearing. If they sold you a dangerous car or gave you a dodgy MOT then you have something to beat them up with as VOSA (the MOT licensing people) will take a dim view of them

    As Paul said, after a year, the gearbox having issues on an old car isn't a shock and might well not be related to the accident. Are you sure it is the gearbox? I ask as a chap near us bought a 52 plate Mondeo off someone recently for scrap value "because the gearbox is making a funny noise". Turned out to be the wheel bearing and a tidy profit made on an otherwise well looked after car.

    Selling the car isnt an issue. Have the gearbox rectified first though or it will be worth peanuts.

    Simply get an HPI report done, showing when it was written off and put back on the road, price it a little bit below other similar cars and put in the advert 'please note this car was subject to an insurance claim in 'month / year' however has been MOT'd since. It is on the VCAR register with a category of 'C or D'

    Firstly *ANY* car thats second hand, years old, in the £1000+/- region can go wrong after any amount of time.

    Secondly if the car is a Cat D write off it may not be on the V5. Therefore the seller might not of even known about it and the fact that you've only just discovered it's a writeoff suggests that its not on the V5 you have and is therefore a Cat D.

    Category D is typically bodywork damage - IE a small dent somewhere, scratch to the paint etc. Something that would of cost roughly 2/3 the value of the car so the insurers decided not to bother with it and just pay out some cash instead.

    So to put this into context, any old car will go wrong at some point. It's inevitable they all do. There is no such thing as an old car that is in tip top condition and never goes wrong.

    You've had the car for over a year so after your use of it for a year it's quite normal for something to need attention. Thats why people with old cheap cars usually get through a lot of cars - because the repair costs usually outweight the cost of another banger (note that banger today covers a vast variety of cars that are often smart, well kept but just in the top end of the banger price range - it doesn't mean that the car is a wreck like in the 70's/80's/90's).

    Don't think that anyone who sells you a car is automatically a con artist, there are good cars out there in that price range but you have to do your research. Even then those cars can often have problems months down the line - it doesn't automatically mean the seller has ripped you off OR has any responsibility to put it right for you.

    £1200 divided by 12= £100
    or £1200 divided by 365 days =£3.28 per day
    plus car still worth at least £400 on ebay

    sounds cheaper than avis to me
