Section 75 Flights Query

Hello,

I booked flights some months back with Kingfisher Airlines from London to Bangkok return on 30th March and 21st April.

It's looking increasingly likely that this flight won't go ahead with Kingfisher's difficulties. My travel insurance is telling me that I'll need to claim from Kingfisher, but I imagine it'd be like getting bloody from a stone, so I was investigating Section 75 claims as I booked through a credit card.

However, I booked through a third party, in this case eBookers. Would my credit card pay out as if the flight did not occur, or would they say that eBookers as the agent, has supplied me with the ticket as contracted, and refuse my claim?

If there are any experts out there that could shed some light, I'd be eternally grateful!

    you need to wait first, but ebookers is your contract and seciton 75 is broken this way
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

    From the financial Ombudsman: 'Where customers use a credit card to buy airline or other travel tickets from a travel agent, they cannot normally claim against the travel agent if the airline delays or cancels the flight. This is because the travel agent contracted to supply the ticket, not the flight. So the customer would not have a claim under section 75 either.
    However, things are different if customers use a credit card to buy the travel agent’s own "package" of travel arrangements. In such instances the agent is the supplier of the holiday package.' (and Section 75 would apply)

    No harm in making a claim through your credit card but don't be surprised if it is rejected.

    If you need to go through Kingfisher and they go into admin, don't hold your breath, customers of Oasis airlines received no more than a 5% refund on their ticket after that company went bust.

    if the airline fails to deliver and your not insured for that, could you perhaps ask you card company to attempt a chargeback? Particularly so if it was a visa card. I'm not sure what timescale applies though - someone here will know
