Hi
I had a car loan with Welcome Finance which ran from approx 2004 - 2007. I complained to Welcome, who I think sent me a final response but I can't be sure. They declined to refund my charges back.
At the time, I was working for the FOS so I didn't take it any further - I think out of embarrassment than anything else!
Does anyone know if I can still claim? Have they changed their stance? Is it worth me submitting a data access request to them?
I'm not sure of the address now but sure I can find it.

So you got a final response in 2007. Presumably it gave you a six month time limitAt the time, I was working for the FOS so I didn't take it any further - I think out of embarrassment than anything else!
Then you will know that FOS will extend the time limit in "exceptional circumstances" if you have evidence of this.
What are you going to claim?

It is well worth trying.
I had three accounts over a few years and I was lucky to be sucessful in a claim for unfair charges.
I used the letters on the site to do the Subject Access Request which cost me the standard fee of £10.00
Once I received these they were sent to me in full and I went about my claim. I still had a default balance at the time and through the claim they reduced my balance so I was able to clear it in a small payment from my salary one month.
I had nearly 2k in unfair charges. It did take me just over 9 months so it was a long haul. I did not have PPI so couldn't claim for that. Do everything in writing and send recorded post. It is a nightmare if you do not they claim they do not receive items etc.

I have compassion for those advisers who sold in good faith but receive fraudulent complaints.
I have compassion for those advisers who end up paying a £500 fee just to be told that FOS has no jurisdiction.
I have compassion for those advisers who dutifully destroyed documents because the Data Protection Act told them they must but FOS now makes them answer complaints because it has chosen, retrospectively to change the rules.
I have compassion for those elderly advisers who are now persecuted by FOS and being bankrupted by FOS decisions which fail to take proper account of circumstances nearly a quarter of a century ago.
When one of them is driven to such despair that they take their own life (and it is "when", not "if") will you be proud to have been part of the organisation responsible?0
