Used car warranty - dealer will only let me take car back to him !

Bit of help please !

I purchases a 2nd hand car - Peugeout 1.4 HDI 68K on January 6th 2012 for £1550

This was purchase from Williams of Nottingham - a trade dealer.

This came with 3 months warranty - which I am still within - HOWEVER the dealer is refusing to pay the last bill as the car was not returned to him in Nottingham (the warranty stated I have to get the car back to the dealer - and as such I would have to pay for a tow truck) - and also on the morning of the first incident - he did not answer his phone ! So I had no choice but to recover the car to an RAC approved garage for repair.

The coil shock snapped whilst driving, resulting in a new coil / strut / tyre and labour - total bill £286 - this was on Tuesday 14th Feb - just over a month since the car was purchased.

Dealer refuses to pay his 50% of the bill as the vehicle was not returned to him for repair ( even If I could have done this he was not contactable to arrange this !)


Tonight March 6th - on journey home from work, 1st and 2nd gears fail, warning light on and I am left stranded. ( I was parked at lights, put car into neutral, and then when I went to pull of in first, nothing !)

* RAC man thinks it is an internal issue - but can only tow me to local garage - not the one in Nottingham

* Dealer in Nottingham when contact said that the repair CAN ONLY BE DONE AT HIS GARAGE - despite the wording on the warranty saying it has to be done by them or one of his agents

* I will be calling the local garage in the morning to find out rough cost of repair and weigh it up against cost of recovery to Nottingham.

The warranty is on a 50/50 split basis.

My main question is:

* Can the dealer refuse to give me an approved agent close to where I have broken down - and tell me that only he can do the repair work, despite the warranty saying otherwise ?

* Would I be covered under the sale of good acts ? And if so should I be expecting him to foot the whole bill, as he has sold me a car that is not fit for purpose ?

Any one that can help ? would be much appreciated - I brought the car after loosing my old job, as my new one is a 70 mile round trip, so I needed something economical, but the cost of these continued repairs, plus the £150 service I had it put through is really mounting up now !

    your first bill is way out
    you should have paid for coil labour and tyre
    there was a recall on these for spring cup modifications depending on year model or was that just citroen?
    yes you need to get vehicle to him its in your terms

    us traders do keep advising that its often better to pay a little more but to buy local because lets be honest you all love bugging us on a saturday morning when we least need it with your foibles but thats why you pay us more

    Dealer needs to know your not having him on. Not his fault you live miles away.

    Take the car back to him and get him to fix it. Again not his fault you dont have the right
    cover to take your car to the garage of your choice.

    Upgrade your cover.

    I paid £120 for a pair of front springs on a mondeo fully fitted. A strut would have been another £40 - £60.

    So i think you may have over paid a bit. Garage probably could have done both front springs and shocks for less.
