PPI sold through car dealer

Hi

I was mis sold ppi on a car loan in 2002 and have since been pursuing a claim through blackhorse who the agreement is with. It has now been 8 weeks and I have had a response not upholding my complaint. I have appealed this decision and gave 14 days to reply but had nothing back.

I called them the other day and they were not very helpful. They put me on hold and then said there has been no change in the decision. I have not had a letter with a final response yet so should I believe this decision?I will be sending a final letter shortly along with a copy of the appeal letter.

My question is what else should I do and am I wasting my time in chasing Blackhorse?

Should I go straight to the underwriter to claim this who is Genworth Financial?

If I was to go the underwriter route will I get back my interest that was paid on top of the original front loaded ppi as well as 8% redress?

I know I have a lot of questions but it seems that I am not getting anywhere with this yet there are so many other successes listed that seem a whole lot easier to obtain. I don't know what to do now!

    The dealer is responsible for the sale, not the lender or the underwriter. They simply provided what you asked for.

    If the dealer no longer exists then you have no source of redress, I'm afraid.

    Thing is I didn't ask for it. They said you need this to get the credit so was mis sold so what do I do?

    This was front loaded as well so surely I can go to someone. I didn't say oh I want ppi as well.

    Going through exactly same thing with Black horse and carcraft. They are passing me back and forth. BUT i found out i had full sickness cover from work and had private health insurance when PPI was given, They told me i had to have it lol x
    The feeling i got when i confirmed my place studying criminology at Exeter Uni was brilliant!!!!!

    i dont know where to go from here as my thinking is basically the car dealer was acting on Blackhorse's behalf so Blackhorse should be liable for the sale as well. How can they be approved agents selling Blackhorse products yet Blackhorse dont want to take responsibilty?

    i will be calling them again tomorrow!

    Because they were independent and Black Horse had no control over their actions. An independent adviser acts for the consumer, not the insurer.

    Just called them up and still not upholding my claim. Should get the final response letter soon.

    Will FOS take this on as it was sold in 2002 and they weren't regulated till 2005?

    May have to start a new claim directly to the insurer/underwriter as these were regulated so may have a better chance.

    So all in all this is a failure for blackhorse ppi. Not happy.

    Since you are complaining that Black Horse missold something it did not sell at all, it is doubtful.

    The mere fact that they were regulated does not mean they missold something they did not sell either.
    So all in all this is a failure for blackhorse ppi.

    No it might be a failure by the dealer, possibly by the regulator, but not by Black Horse.

    Your answers are not helping. I have said the dealer is not longer there so how can I reclaim my ppi that was definitely mis sold!

    This forum is to help and advise not give blunt answers.

    I would like advise on what to do, who to send my claim to as sending it to blackhorse has got nowhere.

    I have the original agreement and there is no tick box on it for ppi just says gold for the product and this was the only paperwork produced to get this loan. If I didn't sign this then I couldn't get the loan. My needs were not assessed by any questionnaire or anything and I was living at home with a stable job yet had the most expensive product applied.
