csa rip off

ever since i split wife the ex wife ive paid maintenance and bought clothes for over four years this was fine but the last six months the clothes stopped returning back when i picked my child up from school so i have to go out and buy more clothes i dropped the maintenance so i could buy more clothes to replace the ones that hadnt been returned ,the next thing i know the csa are on my back and have gone back over four years to work out my arrears and what i need to pay each week.the way the csa work is un-fair they havent left me any money to buy food once my bills are paid and have told me if the clothes arent provide ive to buy them but what with if i work over i will have that money taken off me too why cant the gov get rid off them .

I very much doubt the CSA have told you you have to provide clothes!!!! They are only interested in your assessed CM, so long as you pay that (and any arrears if required) then they are not interested in anything over and above that you might choose to buy.

Was a case with the CSA opened wen you and your wife first split? If so I assume your on CSA 2?

Your notnobliged to spend any more then what the CSA have assessed you at so by dropping your payments to cover clothing they wont care about. How long were the paments reduced? Have they given you an accurate arrears figure?
  • I have a similar problem that I normally collect my daugher from school on a Friday and return her on Sunday but don't see the clothes she goes home in again.

I've told the ex that on a Friday she needs to provide clothes to go home in for Sunday. On the occasions that she doesn't my daughter ends up going home in her freshly cleaned school uniform or when I drop her off she goes straight to her room, changes and brings down the clothes she was wearing for me to take back.

It's a silly situation but after losing about 80% of the clothes in her wardrobe at my house I've run out of options.

It sounds as if he has been told by the CSA that they can't figure into the calculation the clothes he buys, so if clothes aren't being provided by the ex, then he has to provide them. That's common sense, the children can't walk around naked.

OP you need to learn from your mistakes. You cannot lower the child support you pay to your ex yourself, it has to be agreed by the CSA or you will end up owing arrears. They are quite ruthless when it comes to collecting arrears too and have no consideration for how the NRP can afford them.

Clothes not being returned is a common frustration for separated parents. Golddustmedia suggested a couple of options.

And we go back to the same old situation, the NRP gets screwed again...!

Just be thankful you don't have "shared custody" and then still have to pay her the CSA because the law says the child can only live in one place...! Imagine having a week at yours and a week with mother, but still having to pay for the week at mothers while you get nothing...! And then the PWC is legally entitled to claim CTC CB etc while you cannot legally claim anything... Really fair system...!!!

hi, i've made this group to try to get people together that think parents should have equal rights regarding kids after seperation, women are also invited as i hope to get enough people to take on a public argument with the CSA regarding maintenance payments when the residential parent refuses out of pure spite, for money or any other reason.
we shouldn't have 7 year court battles for access and longer in some cases so please feel free to add the group and please notify people who you think may be interested.

please check my group as i think csa must be fairer for all and the NRP deserves rights also, not just financial rights either.

    a) because thousands of 'parents' would refuse to make any maintenance payments without the CSA
    b) because thousands of 'parents' seek to use with-holding or the complete withdrawl of maintenance as a means by which to control their ex partner
