I can't understand why the other party's insurance are going 50/50 if they are claiming your father "rolled/reversed" into their car.
Surely they would claim 100% fault if they are saying it was your father's error.

My sympathies to your Dad, most of us remember when if you ran into the car in front it was a slam dunk and you coughed up.
I'll bet this involves budget, online type insurance companies. They really don't give a toss, everything is on screen for the (two week trained) adjuster and all the algorithms are set to minimise costs. They are betting, and are usually right, their interminable delays and paperwork searches put off genuine complainers and really just want the claim off the books as they are going to recoup the money anyway by bumping up both parties future car insurance.

This is an insurance company fiddle - companies rarely fight smaller claims anymore, preferring instead to spread the cost amongst themselves by taking a 'swings and roundabouts' approach.

I would be inclined to go with the advice already given - check for Legal Protection on the household policy, and then go for both the other driver and the insurance company.

Fight it if you can. Anyone want to bet the woman will come back with a claim of whiplash due to the impact from the "reversing" car?

Many thanks again for all your replies.
He phoned his insurance this morning and said he wouldn't accept 50/50, and was asked to hold while they spoke to a manager. They took the info again regarding the changing story and said they would call back. they have now called back to say they are writing to both the other insurance company and their solicitors to say they will not accept 50/50 and are going for full costs.
thanks again for giving us the ammunition to fight this, you are all great.

If after the appeal this still ends up 50/50, then he can still claim (and would get paid) 50% of his uninsured losses back off the third party insurer. (eg 50% of any excess he had to pay/taxi fares/hire car etc)

An make sure your father claims for increase in premiums for the next 5 years too. They will go up regardless of fault.

Excellent point!. Do insurers prefer 50/50 claims as two drivers will subsequently lose NCB.
