Littlewoods Catalogue; is it unenforceable??

I took out a Littlewoods Catalogue a long time ago now; BEFORE 2000.
I am just about to send them a Section 78 request for my credit agreement as I don't ever recall signing for one.
I signed an application form from someone in the street who was touting for their business!!
If they can't find a signed agreement which is very unikely given how long ago it was taken out, does anyone have a link for a template letter to which I can send them please??
I am also needing a template letter as Littlewoods over the years have charged me for late payments fees so I wish to claim these back plus interest!!
Would a catalogue debt (only £160) fit the unenforceability criteria if no signed agreement is provided??
Any help please thank you very much xx

How long since you last made a payment, or acknowledged in writing that you owed the money? If the answer to both questions is more than six years, then do not waste any further time or effort on it as the debt is statute barred and therefore totally uncollectable. What say you?
Or, I will amend in view of the very long time scale, did a six-year period elapse during which you did neither of those things, even if you have done something more recently?0 -
I have never acknowledged I own the debt, I made a last payment recently but I have a buy now pay later on it which needs to be paid by end of the year.
If they cant produce the CCA within 12 days what can I do then!!??0 -
ermmmmm how about paying for the goods u received on buy now pay later???On the road to financial freedom.... one MSE penny at a time....:T0

So presumably the £160 outstanding balance is from this recent credit that you took out?
Littlewoods are unlikely to have an agreement from 2000, but you would have to make sure you didn't make a new agreement when you took out they latest credit. New debts can have a fresh agreement taken out online or otherwise, and when it comes to enforcement through the courts do not need a signed CCA as they would have done for borrowing on an account taken out in 2000.
Also, what is the problem with the £160 debt? Seems quite a small amount, and not worth getting a new default for it unless you simpley cannot pay it whatever happens.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

I haven't signed a new agreement with Littlewoods since I signed an application form before 2000.
I don't order online; Littlewoods have never asked me to sign a recent agreement.
I want to reclaim back ALL the late payment fees that they have charged me over the years; the amount would pay off the £160 which needs to be paid by end of the year.
How should I word a letter to reclaim all these fees!!?? Am new to this so don't know what type of letter to do.
Thanks for the advice so far!!0 -
Mumz, you need to sit down and give a proper account of what the history of this account has been. It is far from clear to me. I had assumed it was a historical one, but if it's ongoing, it seems what you are looking at is reclaiming the "late payment fees" to offset the balance? When were these fees charged? We really need more detail or we are rather thrashing around in the dark here!0

It probably would as most catalogue companies can't provide a signed agreement as they don't ask for a signature before sending out the goods.I took out a Littlewoods Catalogue a long time ago now; BEFORE 2000.

But for such as diminutive amount, is it really worth the hassle of challenging the debt? I'd do it for £1,600 but not for £160!0 -
I think you should just pay it.
I mean you ordered items & paid late so its your own fault really.
Wish people would stop trying to blame their debt problems on everyone else.0 -
I've had quite a few late payment fees over the years.
Because I am on benefits, I get paid at different times throughout the month, and I couldn't always pay on the due date!!
Is there a template letter available to reclaim late payment fees from the catalogue company??
If I could reclaim some of the money back it would pay for half the amount due at the end of the year!!0 -
I'm not sure about any letter templates but someone on here will probably be able to provide you with one.
I'm not sure they will give you anything back tho cos something similar happened to me years ago when I was made redundant all the late payments stayed on the account.
