Parking Tickets New Car

Hi

I am worried I may have some old parking tickets on a previous car. This car was written off in an accident two years ago. I am worried that if I purchase a new car - I will be liable for the old tickets and my car could be seized.

Any helpful advice?

Firstly yes you ARE still liable for your old parking tickets from your old car. Why you've not had a visit from the bailiffs yet is beyond me however it could still happen at any time OR the council might of given up and cancelled them (assuming these are council PCNs and not private company scam PCNs).

Secondly a Bailiff can pretty much take anything they want. I'm not up to date with the current rules on the recovery of parking fines but a couple of years back there was suggestion of bailiffs being allowed to force their way in to recover parking debts for authorities. No idea if thats gone through and been approved or rejected so you'll need to look into that seperately.

As for the new car, grey area I'm afraid. The council can lookup a car registration that they've issued a PCN to and then send bailiffs etc. What they can't do at the parking office is to lookup any other cars registered to the same person and naturally without those details they can't pass them to a bailiff to seize a different vehicle. That said, a bailiff can seize goods that are known to be yours outside of your home and cars (especially those on your drive) are often favourites to immobilise with a clamp (note that they must be SIA registered immobilisers and have a licence to clamp a car). That said, if its your primamry way of earning a living they may not be allowed to. It's very grey territory as to whether a bailiff can lookup a registration with the DVLA.

If you're at the same address that won't help because the bailff won't find it hard to find you and your car. If you've moved and the car is parked on the street you've probably got more protection because not only are they not going to look up an entire street of cars at £2.50 per pop, only the police / DVLA can seize, immobilise and/or remove a vehicle on public land AFAIK Bailiffs can only do this to vehicles on private property. I may be wrong about that though so you need to do some research.

Ultimately, they can't take a car that is not registered in your name. If you have a willing family member, register it in their name (just be sure to keep both keys yourself and the written receipt etc so they don't sell it from under your feet).

They'll be more than just parking fines now. They'll have escalated the charges exponentially already.

You have not said if it was a council that issued them, if not continue to ignore. If so then check with council, it'll be expensive but cheaper and less hassle than with bailiffs.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.
