Can a shop sell you a refurbed item without telling you?

Seriously annoyed by this. Store closed, so looking for some help here before I ring them tomorrow.
Hubby was looking for a particular sat nav. Found it at a good price on Argos website, and it was in stock at our local store. I picked it up the next day.
Hubby was playing with it and realised that the maps weren't updated. Went online to do it (item supposed to have a map guarantee) but he couldn't do it. Contacted Tom Tom who have come back and said that as it's a refurbished item he'll have to pay for the map update.
There was nothing online, on the receipt, on the *sealed* celophane wrapping, or verbally to suggest that the item was refurbished.
Being refurbished means that it will cost another £45 to purchase the latest maps.
Sat navs are automatically excluded from Argos' 30 day money back guarantee, so it must have been faulty at some point.
Where do we stand with this? Can they sell something that's been refurbished as new, and require us to incur further costs? :mad::mad::mad::mad:

I dont think they can, they have to inform you that its a refurb. Sounds like its a return that someone didnt put in the right place for returns.0

It's likely that this is a return that, for whatever reason, has found its way back into the stockroom rather than attempt to deceive you by Argos. Unfortunately,according to theonline stock checker they don't have any more, and OH has fitted some of the parts to his motorbike already.

Have you checked other local stores, even ones in the next county, maybe ask them to get 1 from another store for you to pick up(should be easy for them to sort out).0 -

Well not saying they could 100% do it but no harm in asking, if you dont ask you dont get.0 -
I would be being more assertive.
You need to tell Argos to get a new replacement for you.
Then when they have it in store, take your one to them and exchange.
You will however need to remove those bit already fitted to the bike.
An alternative might be to get Argos to give you a partial refund of £45 (the cost of the map update) and you keep the already partly fitted item.
But that's clearly up to you.0 -
I sorted it all out yesterday. Central customer services agreed to replace, so I went to another store (13 miles awake) that had one in stock and just replaced the unit. Got it home, same issue.
Spoke to TomTom who confirmed neither were refurbished (:mad:) and manually provided the map upgrade.

Hard to tell. TomTom didn't know why there was an issue, so maybe Argos did something with the serial numbers???Science adjusts its views based on what's observed.
