Can anyone help please ......
I have worked from home since 2009, and went on Maternity Leave in Jan 2011, due to return to work in Mar 12. Whilst on leave I relocated to a new area. At the beginning of Jan this year work asked for a meeting to discuss my return to work, I was pregnant again at this time, and notified them mid Jan (before the meeting). At the meeting, work informed me my job would now be office based. I told them this would not work for me as this was now over 200 miles from my new home! They are now making me redundant and have offered redundancy, and are paying 39 weeks of SMP, however they will not give me all the benefits I would be entitled to were I still working for them and on maternity leave (ie car/fuel allowance, holiday etc). I received all these benefits whilst on my last maternity leave and they amount to around £8K. Is this allowed?? Many thanks, LG.

When you are made redundant all the salary related and any other benefits of your employment cease. That is it, end of it all. Redundancy is not maternity you do not keep benefits of employment. They do not and are not required to pay you for holidays / fuel allowance etc for periods of time when you are not employed by them.
The 39 weeks of SMP are being paid because they are statutorily obliged to pay this if you qualify for SMP and are made redundant.0
