    Just so you know, if there HAD been a court order, and it was superceded by the CSA, then it would have to be applied back to court, as the CSA effectively cancel the order when a claim is made through them, This can only be done 1 year & 1 day after the Court order was granted.

    And as there was no order in the 1st place then it is very very unlikely that one would be granted. Regradless of education status.

    In law it is called CHILD MAINTENENCE and you stop being a child well before your 19th b/day...!

    yes she does stay with us, but, since we arnt able to give her , her own room, she wont stay permanently, its bed sharing, as i have two girls in one room. We have tried that one before, but her mum will always deny making her homeless and deny that she stays at our house!!

    I totally agree kev, about cm stopping before 19. Only we can have 19 yr old children and adults at the same time.:mad:

    Found out today she hasnt been to college since christmas, so that will be another phone call i think, my husband pays maintenance as she is in full time education not for a laugh.

    kev, u have just put my mind at rest, i have it in my head how many more payments they are, and the thought of it going on another year almost tipped me over the edge :(

    Don't want to scare you but I seem to remember hearing something about a 'child' who is still in education after 19 when the CM ceases taking the NRP to court to claim maintenance to support them through college. However it's not the PWC that can do this but the child can do so.

    The daughter can apply through the courts for continued maintenance but this would only be possible whilst said daughter is at uni and may not be successful. The PWC cannot apply.

    oh dear, we were depending on the final payment being paid, to finally get into the black and not in the red.

    The daughter hasnt been to college for the last five wks, she keeps saying she is going to call them and sort about getting back in, just not sure how to play this one!

    She is currently in college kellogs, so would that mean, once her college course has finished, and if she goes to uni, she could still claim csa off her dad, as by then she would be 20:eek:

    She wouldn't be able to have a case on the CSA open beyond her 19th birthday, whether she was in education or not, and no matter whether or not child benefit was still in payment.

    hi, my stepchild turned 19 last month, the following week we received a revised schedule from csa as we are still paying for oh youngest son. as we are on csa1 the difference is only £20 odd quid but it does end on their 19th birthday regardless of staying in further education after that date. i have no experience of a child using the courts to claim further support from absent parent but i know how hard it is to get into university, my eldest is currently going through the process, i dont know how much this post will help you but would her grades be good enough to gain a place and she would have to pay to use the courts.

    you need to change your name a bit of help, you are in fact a lot of help, when i read this morning about his daughter claiming in her own right i felt sick, we have struggled for years and years. Not saying he shouldnt support her , but come 19/20 it should be his choice and not hers.:o

    Your right about uni etc, being difficult to get in, no her grades wernt great, hence why she still doing a second year at college now, she got held back a year initially, to get her grades up to scratch.

    i'm glad that i may have helped you, csa is hell but we had no issue paying it & we only have another 3 years to go (oh youngest is disabled and we expect him to stay on at his special school until he is 19). i can understand the need to pay for csa until a child is 18 and in further education but really 19? it would be intersting if anyone reading had the experience of being taken to court by a child for further support whilst in uni. we attended an open day for my childs first choice recently and i was told by one of the students that she didnt know of anyone supported by their parents, it was a combination of student loans and part time work, i suspect a judge would rule the same.
    ps a lot of uni's have closed the applications for this year as they are over subscribed so unless she has an offer all ready she may struggle to get in, thought it might help you, my childs first choice closed to new applicants in jan of this year.
