Halifax? Cheeky or just wrong?

Hi guys and girls,
I sent a few letters off recently asking for copies of my CCA, most banks in fairness have responded within the 12 days but the one from Halifax regarding a credit card I had has me stumped.
Their response is,
Dear Mr C.....
Thank you for your letter dated 18th February 2012 (it was dated the 14th by the way) regarding your above credit agreement.
Section 78 only applies during the lifetime of the agreement. As the above numbered account has been closed, there is no longer a regulated agreement between ourselves.
In view of the above, we are unable to provide you with the documentation as requested.
Yours sincerely,
Anne Garbhore.

Smells a bit like BS to me what do you guys think?

    They are spot on.

Seeing as they are correct then the BS isnt coming from them. You sent the wrong letter. Ironically, your request was BS if we stick to using your phraseology

  • So I should have gone straight for an SAR request?

Why, what are you trying to achieve? If the Halifax CC has been closed, and the balance (presumably) cleared, why would you want or need a copy of the original agreement?
  • I had 2 credit cards, both now paid off, one definitely had PPI on it and I want to check both cards credit agreements to see which or if both had PPI on them. My reason for this is I was a student at the time of application, therefore any payment protection is irrelevant.

Then submitting an SAR is probably the first step.
  • Thanks antrobus
