A little bit of guidance with PPI and Abbey.

Hi,

15 Years ago we bought a new house from persimon homes. we where first time buyers.

As part of a tie in with Abbey National we where told that if we used the Abbey for a mortgage we would get our new house carpteted throughout.

We went with the abbey for the mortage and also took out the Payment care package with it which was basically a way of pretecting your mortage payments in the event of ASU.

We have always been with Abbey (now santander) for our mortgage and have moved again since.

We have always had this payment care cover but we are now looking to cancel it as we are paying over the odds.

My question is I can not say whether we where mislead into the selling of this PPI as I can not remember what happend 5 years ago never mind 15 years ago. also take into account I would have been a little nieve at the time (fist time buyer an all).

Should I be looking to claim and if so do I need to prove i did not get the advice or is it up to Santander to prove I did.

    Common sense to take it out and still considered best advice today.

    I can not remmember whether I got advice from they Abbey or not as I dont remmember meeting with anyone from the Abbey or going into one of there branches.

    There is nothing wrong with having PPI. So just having the product is not grounds for complaint. The complaints being made relate to the advice you were given at the time and how they were set up.

    MPPi should be set up as a a monthly payment, ideally from your bank account. if it is then it has been set up correctly. All the banks do it as monthly payment so the single premium complaint reason cannot be used.

    So, that just leaves how it was sold to you. You said you dont know how it was sold to you. So, how can you complain about a mis-sale when you do not recall how it was sold to you?

    The bottom line is that this is 15 years ago (well before the 2005 regulation - which may apply if bought via an agency/broker/adviser). It is set up correctly and you cant remember. Nothing you have said indicates any mis-sale.

    Complaining about the mis-sale of a PPI policy invariably involves making some form(s) of allegation of wrongdoing against the person or firm who sold the policy.

    As you have clearly stated that you cannot remember anything about the sale of the policy it so means that any allegation you make must be made up.......which is fraud.

    Dunstonh is really just telling you (in his own inimitable way) that mortgage payment protection is still being recommended and sold today and that "I can't remember" is not really a valid reason for complaint!
