Hi all, i recently received my original T & C's from my CC company Capital one, it does show my signature next to the agreement of accepting PPI and they claim that due to this agreement they cannot repay my premiums! i am adamant the PPI was mis sold to me under the circumstances that for me to qualify for a CC from capital one i had to take PPI due to my previous credit history! what do i do now and where do i stand?

Use the ones that apply to you and ask them to reconsider the claim, did you get this card over the phone?, if you did then you could ask them to listen to the recording that you had to take this ppi or no card.
If it was not done over the phone just ask them to reconsider or you will take this to FOS.0 -

It's alright i've found it, i guess it's a matter of completing the 'questionaire' and writing to ask for a refund as i feel the PPI was missold to me at the time?0

You have already made your complaint though. You cant keep making the complaint over and over. If you have evidence to support a new allegation against them then supply it.
Your choice now is to either accept the decision, supply new evidence to support your allegation or refer it to the FOS. The FOS overturn just 11% of Capital One complaints.
You actually havent indicated what your reason for complaint is or what evidence you have. So, its difficult to comment really on what you should do next.I am an Independent Financial Adviser (IFA). At the time of my request for a CC from capital one i was a year out of a scottish trust deed, i was applying for a CC to aid with improving my credit score, in my opinion i was forced to take PPi due to my past credit history or capital one would not offer me a CC! the CC was for £500! now if for talking sake i had lost my job while holding a CC i would have comfortably managed to pay my debt off without the help of a PPi, what i'm saying is i never requested it off my own back as i had no use for it! And technically i haven't complained i simply requested my T & C's at the time i took the CC out! hope this helps!0 -

An allegation like that is the weakest type of complaint going. Indeed, its even weaker. You are not saying you were forced but you felt you were forced. They say you were not. So, who is to be believed? Easy for you to say that but you had been on a Trust Deed (for others reading, that is equivalent to Bankruptcy in England). So, there is a good chance you would be willing to take less risks and find things that reduce the chances of that happening again. So, PPI is quite suitable in that respect.
So, again, you have a touchy feely complaint reason which is easily countered.what i'm saying is i never requested it off my own back as i had no use for it!
All you need to do is provide them with your evidence to support your allegations and you are home and dry. Without evidence, your complaint is right at the weakest point of the scale and would be quite reliant on you getting lucky with your complaint.And technically i haven't complained i simply requested my T & C's at the time i took the CC out! hope this helps!

I wrote to them some time ago requesting my T & C's but i forgot to sign the paper work, i then called them to confirm my identity, the operator was it in relation to PPi, i answered yes and was told customer relations would answer me via letter within 5-7 days, i initially received a copy of said T & C's and then a day later i get a letter stating due to my signature agreeing i wanted PPi they are not in a position to repay my premiums!
The difficulty i have is this goes back to 2007 so I’m unsure of what evidence i could possibly hold?(with all due respect) but i am adamant i was not offered the option to take PPi i believe it was forced upon me!
And no i have not received a letter telling me about the FOS.0
