The Nottingham Building society have rejected our ppi claim and said this is a final response to the complaint and suggested we refer to the financial ombudsman service, what should we do now, do we send the same letter to the fos, is it worth following up with them????

You didn't describe why the lender rejected your complaint, but the short answer is to refer to the Ombudsman if you think you have been wrongly refused. The Nottingham Building society have rejected our ppi claim and said this is a final response to the complaint and suggested we refer to the financial ombudsman service, what should we do now, do we send the same letter to the fos, is it worth following up with them????

Whatever their reason for NOT upholding, see if there is a legitimate way of countering it (anything you can add that you overlooked initially), add it to your original questionnaire and FOS it but as said by Moneyineptitude, prepare for a wait, good luck

suggested we refer to the financial ombudsman service
They havent suggested that. They have said that if you are not happy with their response then you have the right to refer it to the FOS.is it worth following up with them????
Depends on the reason for complaint and the reason for the rejection. neither of which you have said.I am an Independent Financial Adviser (IFA). Thanks for your responses, I have put the rejection section below for you to see (removed names etc). At the time we took this out we are told it was the best thing since sliced bread and that should anything happen regarding my husbands employment we would be covered. Twice we tried to claim, once her had to go long term sick through an injury but because he got paid for so long we couldnt claim on the ppi. The second time was years later when he was made redundant. We were told that they take the redundacy payment into consideration, break it down into weekly wages and only after that period of time can we claim on the ppi. Needless to say he had found employment before the ppi kicked in!!!!! Here is the section of the letter received.
In investigating your complaint, I have also considered whether it was appropriate to have offered payment protection cover to you given your circumstances at the time that you took the mortgage advance with the society. Cover was taken in the sole name.................... at the time of the application he was in employment with the .......... and I feel it was not inappropriate to have offered payment protection cover at the time. I therefore confirm that your complaint is rejected. this letter is our final response to this complaint. You may wish to refer this complaint to the Finacial Ombudsman Service.0 -
As I said in my earlier response, if you feel that the reasons you have for claiming mis-selling are legitimate (and the one you have provided definitely illustrates that you didn't need it), then refer your complaint to the Financial Ombudsman Service. Don't expect a quick resolution, though, as the FOS is currently snowed under. At the time we took this out we are told it was the best thing since sliced bread and that should anything happen regarding my husbands employment we would be covered. And the current uphold rate at the FOS is dropping. Most recently reported to be 68%. Down from the 92% at its peak. (FOS published the figures in January)
MPPI has a far lower complaint rate and uphold rate than credit card and loan. A lot of the issues that apply to credit card and loan do not apply to MPPI. Complaints do generally have to a be lot stronger on MPPI to succeed.Cover was taken in the sole name.................... at the time of the application he was in employment with the .......... and I feel it was not inappropriate to have offered payment protection cover at the time.
Which is a correct and valid response. MPPI was and still is generally regarded as the only PPI that is worth having. Benefits are in place on the assumption you have MPPI. The FSA still allows MPPI to be put in place at point of sale and mortgage advisers are still required to recommend it where there is a financial need.We were told that they take the redundacy payment into consideration, break it down into weekly wages and only after that period of time can we claim on the ppi. If your redundancy pay is structured as payment in lieu of wages then unemployment is not classed as starting until the end of the period in question. That is quite normal but it does mean you are not unemployed until the end of the payment in lieu period. Actual redundancy pay is not factored in by MPPI. None of that makes the policy mis-sold.Twice we tried to claim, once her had to go long term sick through an injury but because he got paid for so long we couldnt claim on the ppi.
That may actually be an area of complaint depending on how long is long term.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only.
