Hi all, I need ur advice. I went to work the other night and was told there were 14 redundancies they were looking for voluntary first if they didn't get the figures it would then be compulsory. I came back to work from maternity on 30th dec 2011 and had a full yrs holidays to take between jan and march so took 4wk in jan then stagnated the rest I have worked with the company for 5yr this June and am 31 and make 23k per yr. When we received our letters of payment I was the lowest of the 3 shifts as I work nights my co workers of the same age and yrs service got 7k I got 3k so when I asked this b revised I got offer of 4k. Is this fair are they taking my maternity into account why am I not being offered the same as the rest do I have any rights to take this further please help

So stressed as I would take it of it was 7k

    are your colleagues older? This may affect what they get.

    I would ask them to show you the calculation. Do you have a union rep who can help?

    The OP says the co workers are the same age.

    There is a redundancy pay calculator on the link below, but I don't know whether it takes into account maternity leave, that question may need to be answered by somebody wno knows more about redundancy than me. However, even if it is discounted that would mean you getting 4 years and your colleagues 5 years, which can't account for the difference between £7K and £3k/£4K.

    The letters should say how this has been calculated.

    If you returned to work on full pay in Jan and you work notice then the calculations should be based on full pay not maternity since you will have over 13weeks since restarting.

    £23k is 442pw

    statutory redundancy would be 5 * £430 = £2150 so they are using some other calculation.

    What is the breakdown of the payments for yourself and those getting £7k,, you nedd to find out why yours is different and then we can tell you if this needs fixing

    they lso need to pay you a minimum of 5 weeks notice.


    Have you had the termiantion letters yet what is the termination date are they paying PILON or are you working notice.
