    Its nothing to do with them and they cannot do anything as it is a "local" issue and should be resolved by the management in my office! So in other words not much help!

    So if you have wage issues ect would they tell you the same thing? I have never heard of anything like this before.

    Honestly, you couldnt make it up!

    I called the HR helpline and they said they cant do anything and that its a "local" issue and i have to speak to my manager or their manager, ive never encountered HR to be so obstructive....joining the union seems ever so appealing as i can see things getting out of hand!

    SO HR, if local managemnt aretrying to get policy change who are they asking.

    IF it is a "local" issue then thye can just do it.

    Could try going over HR and local management, time is running out, phone/email the top person asking who is resonsible for sorting out the mess, point out that the company has a masive liability if all the people need to take the holidays before the end of the month.

    HOWEVER

    With less than a year service enforcing your right will be hard.

    They can just terminate and it would be upto you to show this was related to trying to get a statutory right to the holidays or potential an illegal deduction from wages if they don't pay the holidays.

    tough call, but if aenough people involved you could get together and elect some reps to talk for the group.

    dealing with the issue is work.

    Back again, tried all your advice and to be honest im still getting fobbed off - im stressed because i dont want to overstep the mark and get sacked as there are no other jobs in the area.

    However if i try to enforce it, take the last week of march off and do get sacked...would being selected and currently undergoing adhoc training to be a supervisor be enough to prove that the dismissal was related to me trying to enforce my statutory right to holidays?

    Ive alo been selected as an Employee relations person as well so there is evidence im damn good at my job after such a short period!

    I thought i wasnt entitled to go to a tribunal for unfair dismissal until after a year?! Or is there exceptions given the situation?

    Apparently its almost confirmed that the holidays will be carried over or paid..but surely im entitled to refuse that regardless of any "issues" they are having with staffing levels (also to note, their turnover is shocking for employees, 10-20 people have left since training ended at the start of feb)

    This is really upsetting me, i struggle with depression, have overcome it an got back into work as you can read from previous posts but im really struggling now and scared it rears its ugly head again basically through no fault of my own - ive tried to accomodate the business and practically been given two fingers back!

    Honestly close to breaking down in tears over this, and thats surely not healthy in any situation regarding work

    Basically fobbed me off and said nothing can be done - ive constantly been asking etc but all i get told is "it'll probably be taken over or paid" I dont want that and the contract states this cannot be done so if they were then some form of written contract amendment would need to be issued to prove this was done would it not?

    Otherwise there is no proof it was carried over

    Have you told your manager HR told you to go to them? Have you told your manager about your contract stating it can not be done - or literally showing it to them on paper?

    I've done all bar show the contract - manager is off now for a week so i think im going to speak to another manager and explain how upset i am, show the contract and see if something can be done!

    Shock, the managers can get their time off....joyful for us poor saps :(

    Talk to another manager while yours is away. Mention that you are stressed and exhausted, and your colleagues are too - and in your capacity as employee relations, you might want to mention that people may end up ill and taking time off sick if they don't take leave. It does tend to happen as people get run down/stressed. And you're right - managers taking leave while not authorising staff leave is very poor management behaviour. They need to lead by example.
