I have been working in a small for firm for close to two years.

I have been told that my position is at risk from redundancy. Even though my letter doesn't state that any final decision has been made yet, it's near 100% certain my position will be made redundant.

I'm a little confused on two accounts.

Firstly, I'm due to have a formal meeting in the next few days. I presume that the letter i have so far received is not notice of a redundancy and but the formal meeting will be. Does that sound right?

Being employed for less than 2 years means i'm not entitled to specific redundancy pay, but am entitled to 1 weeks notice or payment in lieu of that notice, is that correct?

Finally, I presume that I will still paid for my regular notice period as stipulated by my contract re: terminiation?

Thanks

The employer should engage in meaningfull consultation this can be very short but should explain why the work you do is no longer needed and give you and them a chance to discuss potential alternatives.

if there are multiple people doing the same roles then there should be pooling and selection process.

When did you start and what is your contractual notice?

At some point they need to put you on notice or terminate with PILON.

Contractual notice should be paid, exact dates will determine if there is any statutory redundancy.

There is only me from this company at risk redundant as other than the director I'm the only one who is full time. These is little work at the company at the moment, and I can't see much coming in, so I understand the companies position.

My contractual notice for termination for reasons other than misconduct is 4 weeks. There is no mention of redundancy, I presume as it's a termination is covered by that part of the contract?

I started on the 30th March 2010. The employer probably plans to give me notice on 1st March. That means i'll like be 1 day short of two years employment by the time my 28 days contractual notice is up. Pretty sneaky.

They can leave the termination up to the 22march if they pay PILON, you still don't qualify for redundancy as only the statutory notice is added for redundancy service.

    Just so i'm straight.

If on 1st of March, they say, yep it's official your position is redundant, I have another 4 weeks of service (notice period in contract), before I actually am redundant, at some point on the 28th.

I won't be due any additional payment (other than my 4 weeks termination notice), and so will be taxed on my final 4 weeks salary?

My contract states the company has the right not to make any payment in lieu of notice.

Does that mean if told my position is redundant on 1st March, that I could be out of the door as early as the 7th March?
