If your contract says that it is, then it is. We cannot tell you what your contract says.
If you told us what your contract/employer policy says, it might help. You need to copy and paste the bit that deals with how the reference earnings for your contractual maternity pay are calculated.
To be honest, I think that it is unlikely that your employer got this wrong. It could be that the arrangements weren't really written with childcare vouchers in mind and so don't really work properly in these circumstances. That doesn't mean that it isn't contractually binding on both parties though.0 -
Sorry to ask a rather selfish question - I am on Maternity Leave, due to have my baby in 2 weeks.
Due to our earnings, when I go back to work we wont get any help for nursery fees so I thought the voucher scheme would be useful for us.
However, I thought you could only use it if you were using nursery/childminders? OP - is your little one in childcare whilst you have been on maternity leave?
Sorry if that sounds really thick?!Little Man born 11 March 2012 :smileyhea

Sunshine, we have another older child who is in childcare, so we use vouchers for her

Right, this gets even more interesting now
The ammendments to European Law regarding Childcare vouchers & the employers liability to pay for them during Maternity Leave were passed in October 2008
My "Trust Procedures for Maternity Leave" which details my entitlements was written in 2005 & last ammended in September 2007
What Now???
I think payroll are working from this document which is quite obviously out of date.0 -
It would really really help if you could quote the bits from this document that relate to maternity pay.Pure_Genius wrote: »What Now???0 -

Just because it was last revised before some rules change, does not mean that it does not comply with current rules.
What does it say your entitlement actually is? You keep avoiding this question, yet it is the most important one.0 -
Hi there, I am having exactly the same battle with my employer after going on maternity leave in April. I work in the Nhs and would be interested to know which trust you work for. I know for a fact that Nhs trusts other than mine are calculating omp correctly (in my opinion), that is based on sacrificed salary with no further deduction for CCV.0
