  • being told you HAVE to take this product out to qualify for the preferential rate in my eyes doesn't make it optional. Had we not took the ppi out we wouldn't have got the mortgage with tsb and we would have had to look else where. We had tsb as that is who we banked with and thought that's what you did. Obviously I'm wrong and I just have to accept that

It clearly does make it optional as you have a choice:
1 - buy the insurance and get a preferential rate
2 - dont buy the insurance and get the standard rate
Had we not took the ppi out we wouldn't have got the mortgage with tsb

That is not correct. You would not have got that deal but you would have got a different one.

The underwriter route is not applicable here, I'm afraid.

    Hi,

Back in 2010 my mum put in a PPI reclaim to Capital One ltd for her credit card that she has had PPI on since 2003, she was rejected. Recently I seen the following on the MSE site:

Rejected by your bank? Restart your complaint

If you submitted a PPI reclaim in the past, and didn't take it to the Ombudsman, then it's worth restarting your complaint. More than 60% of cases escalated to the Ombudsman have been upheld in the consumer's favour – a shockingly high figure, given these are complaints that banks have already turned down!

If you tried to reclaim within the last six months, and your bank rejected your case, you can go straight to the Ombudsman (see below). But, if you complained more than six months ago, you need to restart your reclaim.

It's simple to do – just use the FOS online form or the MSE template letters to submit your complaint to your bank.

Remember to put in details of your last complaint, including any reference numbers if you have them. Explain that you're unhappy with the bank's decision, and ask it to look again at your case. Don't forget to add that you plan to take your complaint to the Ombudsman if it's rejected again.

I got everything typed up for my mum and got it sent off, she has received a letter today rejecting her again saying they will acknowledge all letters but will not change their decision.

They also state in the letter that she will not be able to take it to the Ombudsman as the original complaint was more than 6 months ago.

    Any advice?

That is the expected outcome. Unfortunately, MSE is wrong in what it wrote about trying again.

Some banks have had to reopen old rejected complaints. They are doing this automatically but if someone wrote in asking for them to look at it again and that person was on the list to be looked at again automatically, then they would bring it forward. So, the MSE article is written with good intention but it is wrong and does not match the rules of the complaints process set out by the FCA.

MSE should delete that article or totally re-write it.

MSE have an interest in trying to drum up complaints. They own resolver - which can be used by consumers to make these complaints.

Resolver makes money for MSE by selling its user's data (mainly to banks...)

Sent off 2 PPI complaints to HSBC for 2 loans around 7 weeks ago. Had no acknowledgement so far so I contacted them by email. Apparently a letter was sent at the end of July (which I didn't receive) and they would issue a duplicate. I'd need to take the letter to a branch as it is regarding the fact they hold my old address (as this is where my old account was registered) to confirm my identity. Is this a delaying tactic? Or am i being optimistic that its an offer? Anyone had this from HSBC?
