Police Seized Motorbike by breaking into shed

  • The police can't fine anyone for driving without insurance - only a court of law can do that. Similarly, only a court can order that points are put onto a driving licence for not having insurance.
Are you sure your 'friend' is telling you the truth, the whole truth and nothing but the truth???

As much as he knows. It's my mothers friends at work. His son bought a bike with this friend, and it's said friend who's been caught (if that makes sense).

So, My mums friend (dad of one of the two oweners) is trying to get it sorted out (as his son is fully insured for the bike, just can't have it as it's in lock up and he doesn't have the money to pay, hence dads help)

If your right about the points and fine that would be interesting to pass onto him.

It would be the standard Fixed Penalty of £200 plus 6 points, not a 'fine' as such.

Not sure how you'd argue they broke in, when he opened the shed for them upon request.

They at least 'attempted' to break in. As the noise of them trying to crow bar the door open is what alerted him to the fact there were three police officers in the back garden to start with.

    :rotfl:

I think there's much more to the story than perhaps even the OP is aware, but I don't think we need to get nasty about it ;)

    .

I take it by it not having plates its a Motocross bike, that's not suitable to be ridden on a public road, therefore your friend's friends dad won't have it insured.
  • ummmm,

You have all made some very good points, so thank you very much.

Going to give him a call and have a chat know I have a little more information under my belt.

Some Police forces do seem to use FPN's for lack of insurance - I stand corrected. But the offence can still be disputed in court if the alleged offender so wishes - just because the FPN has been issued does not mean it cannot be disputed. If the FPN has already been paid, then it is too late to dispute it.
As the offender is described as a 'young lad', there is a possibility he may have held a licence for less than 2 years, and will now need to re-take their driving test.
