Out of a marked bay

Hello,

I would be very grateful for any comments/advice.

Over the weekend i went out to a local restaurant and parked my car which at the time i thought was parked correctly in a normal parking bay.

Next morning I notice parking charge which has been issued from ... saying I was . I cannot prove at this moment in time if this is correct/incorrect

I went back next day and there are lots of notices advising of rules/regulations etc.

If this is true then I have not done this on purpose and i think this is an unfair fine (some people would say I was careless).

It was dark and I genuinely did not see/read these notices.

Does the forum think i have a good case to appeal?

    You have no grounds to appeal (in what passes for their minds) as they would reject it even if the Queen, the PM and the Pope gave evidence for you.

    The good news is that they have no grounds to get your money if you simply ignore them, as their "fine" is nothing more than an invoice inviting you to give some scammers your hard earned money. They rely on "you saw the sign, you made the contract", so you could not make the contract if the signs were not visible.

    In any case, if the car park was free, the loss to the landowner was nil, nothing, nowt, zip, zero. And that's all they could ever take you to court for.

    There are only 3 things you need to do:

    1. Ignore them.

    2. Ignore them some more.

    3. Have a nice soothing cup of tea while ignoring them. :)

    As this is UKCPS be very wary of private messages you might receive and be careful of what information you disclose on here. This is because the parking company monitors these forums trying to glean information.

    They probably will send you some stupid letters, including ones from their tame debt collection company called (believe it or not) "Court Proceedings Ltd". Just ignore.

    But in answer to your question, yes you undoubtedly will get a series of threatening letters. These constitute unlawful harassment. Ignore them, as Al says, but save all letters as evidence.

    A campaign may shortly be going up to adopt a policy of "sue them"- but wait and see!

    And edit your post now, to remove all details that could identify you or the incident. We didn't need them to give you advice.

    Don't reply to any private message from someone who says they can 'help' you. The head tea-boy at UKCPS is Peter Haswell (hasbeen!) and he needs to really get a life but he spends half of it reading threads on here and trying to win the odd Court case, which he is fairly useless at!

    Here is one case:-

The judge asked if this proved I was the driver, so he then babbled on about the Freedom Bill coming into force making the registered keeper responsible.
    The judge replied @ but that isn't in force is it?' Haswell replied 'No ', so the judge dismissed it.
    He then burbled something about a Principle and agent act where the owner or reg keeper of the car is responsible for the drivers activities.
    The judge asked' what legislation is that?'
    Haswell said ' The road traffic act'
    Judge: Well that doesn't apply to this case does it?'
    Haswell: ' No Ma'm'"

  • the car is registered t my othe half ans she is worried (as am I) about receiving futher correspondence regaridng this parking fine.

    Do you think i should write to the private car parking asking for proof etc?
