    i had one today. they want a 100 plus 10 for upto 30 days. very nice of them to wait until the 27th to tell me. i sent my return in may they have a record of it but they claim it was sent back to me. really nice as i owe nothing as i have been making losses over the lat 3 years. a bit unfair to charge a late fee when i was early.

    You picked up the amount due from the pre-submission calculation and then linked to a 3rd party provider (BillPay) - and keyed in the amount you wished to pay. Fairly clear - from what you say - that you didn't actually submit the completed Return.

    Indeed - it would seem so. Annoying as I am normally fastidious about financial things and I don't normally miss things like this.

    I would be appealing that one. The penalty is supposed to about submitting a return, you have ticked that box. There has been at least one Tribunal case where evidence of posting was held to be sufficient evidence to quosh the return, never mind evidence of receipt. If they start fining everyone for every tax return they don't like I'm going to be spending 80% of my time on tax appeal work!

  • I am having a little set too with another one of the tax gathering organisations working on behalf of her Majesty's Government - an electricity supplier.

    They too have invented a new change in the common law; to "a contract is valid from the date of receipt not posting" we now have "All documentation must be typed not hand written" (perhaps they are scanning it using optical character recognition).
    As a one man band and a pensioner I'll just have to play along with this sort of treatment.
  • Well it does seem that I did complete 95% of the SA, paid the tax, but did not go back to the form again to click Next which would have taken me to submit the SA.

    I will appeal based on 95% complete and tax paid and the fact that it is unclear that payment does not constitute submission.

    I'll come back to report on update and hope that I can get decision overtuned otherwise an expensive mistake!

    Well I wrote a letter, explaining what I had done and have just received confirmation that my appeal has been succesful and that the penalty has been waived.

    they lost my form. they sent the normal threat and a 100 quid demand. i complained they sent out a duplicate tax form and a new deadline of mid april and cancelled the fine. sent that back the next day. two days later i get a letter telling me that i could get a 1600 fine for not filling a return in.
    i wonder why the country is broke.
