Please Help - Making a PPI Claim on Barclays Credit Card

I am helping out my mother in law with her application for reclaiming PPI.

She knows she was offered insurance on or or more of her account (Barclay Card, Loan and mortgage) but not sure which one exactly.

Also, she does not have a copy of the terms and condition.

Following the guide on moneysavingexpert website, I guided her to take the 1st step and write a letter (including a £1 cheque/check) and sent it to Barclays.

She recently response with a letter + a copy of terms and conditions.

I did look into the terms and conditions but did not find anything relationg to loan cover/PPI on it.

However, in the cover letter, there was a phrase used in it which i have copied verbatim below:

"I enclose a reconstituded copy of your credit agreement. A copy of the terms of your credit agreement as varied in accordance with section 82(1) of the act has been (or will shortly be) sent to you under seperate cover"

I did checked the terms and conditions as well and nothing relating to PPI or loan cover etc but she thinks she was sold it.

What do i do next....Should i still get her to fill the claim form???

I'll appreciate every help I can get.

  • If it was on her credit card the PPI would show on her statements. Depending on how old the cc/loan/mortgage are if she doesn't have any paperwork the best bet would be to send an SAR - records are kept for 6 years or sometimes more. You'll find instructions for sending an SAR on this site somewhere, it costs £10 and Barclays will have 40 days from receipt of the request to provide all information held (send it recorded). Provide any account numbers and any previous addresses if relevant.

Being offered or taking out PPI doesn't mean it was mis-sold. She will need to have a reason for a mis-sale and ideally be able to prove it.

It helps to know as it can make a big difference (insurance on mortgage is quite normal and to be expected given the size of the debt for example)
I did look into the terms and conditions but did not find anything relationg to loan cover/PPI on it.

Not a surprise. Many insurances are standalone and not directly linked to the debt (indeed, this is ideally how they should be)

What is her reason for complaint?
How can you complain if you dont know what she has and why or how it was sold and set up?
I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. Thanks for your response. She said she was told by the financial advisor that sold her financial product that if she did not take up insurance, her loan will not go through and that it was a requirement for her to get the insurance for it. She was not told that she could opt out. Being a new migrant to the UK at that time, she accepted what the advisor said and took PPI.

She isn't much of a detailed person so she rarely keeps documents.

If the insurance is separate, how would I find out who the insurance is with?

Can anyone kindly tell me exactly what next step i should take please as i'd really want to help her out with claiming this.
