How do insurance write offs work?

I recently went to a Garage to buy a car I liked, there was one I really like, and put a deposit down for it as well. Having check it in My Car Check, it turns out the car is a Category D write off. We called the garage, telling him, our insurance is going to go up and we would like a refund of the deposit. He said there are no refund on deposits and refuses to return it. He said the car is in good working condition and will come with a full M.O.T. and 6 month warranty. I don't know what to do, or whether I have any rights in getting my refund.0

Just an update of this in case anyone else is in the same situation.
After sending them the "play fair or it's off the the FO we go" email, I got a call from them saying - surprise surprise - that actually the cat D registered against my vehicle was a "mistake" and should have been against a VW Polo instead.
They were thus prepared to raise their offer to £675. After a bit of to-ing and fro-ing we settled on £800. Replacement car was £360 + train fares to go pick it up so all worked out for the best.
So my advice from this would be - If Hastings say your vehicle was a cat D write off CHECK IT as they make "mistakes"!0 -
