Loan / criminal conviction

Hi Guys,
Im sorry im not sure if this is the right place but as its concerning a loan Im posting here :)

Im hoping for some advice. Around 15 years ago I opened up a credit union acc in my name. My partner lodged 2000 into it and then not long after he convinced me to take out a loan of 8000 for him/us to decorate our home. He was in control of the finances and then refused to pay back the loan. I could not afford to as he control my finances. No repayment was ever made on the loan.

I was eventually charged with 'obtaining property by deception' a few years later and received a criminal record I am now separated from my ex.

But what worries me now is that the credit union are now seeking me to pay this money back along with the interest. I cannot afford to pay this amount of money back. I never even got spending any of the money and I was also charged and have a criminal record.

Maybe its wrong of me but I feel I have been punished enough for this, my stupidity and naivety resulted in my criminal record.

I was 18 at the time of the offence and my partner was 35.

SO my question is, can I be forced to be this money back?

Providing you have not acknowledged the debt or paid anything towards it for six years (five in Scotland) and no CCJ has been made, the debt will be Statute Barred. They can chase you for it, but they cannot persue it through the courts.
I used to think that good grammar is important, but now I know that good wine is importanter.

What did the court order say?
Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.

Yes, it is wrong of you. A criminal record does not cancel out the obligation to pay your debts. Why would you even contemplate not paying back a Credit Union?

I had no choice over whether it should be payed back or not. I was in a violent relationship where he had control over everything. I was not in control of my own finances and to be honest, i was more afraid of him than the courts.

I dont understand. There was no court order.
I was charged with 'obtaining property by deception' and given a 6 month prison sentence suspended for 18 months.

But now you do have a choice and a chance to make good. To refuse to repay a Credit Union would be pretty shameful, we are not talking about a bank that can afford to write off the debt.

If I was in a financial situation where by I could pay them back then I would but unfortunately Im already struggling. It was a long time ago and Im not the same person I was then. I understand it is not a bank, but the rate I could afford to pay them back would be so small that it would hardly make a difference to their banking balance.

Then contact them and explain your position, and make a payment arrangement. It will make a difference in the long run. If you really are a different person now, then I am sure you can see that it is the right thing to do.

I meant a different person in the fact that Im a stronger person and would never be naive enough to make the same mistakes twice.

I never spent any of this money, I never owned any of the money in the account. I was only stuipid enough to open an acc in my name. I was charged for this and now have a criminal record which has affected my employment.

FOr me to pay this back would cause hardship to me and my children and to be honest, they have suffered enough at the hands of this monster so forgive me if I dont feel like making them suffer anymore because of him or what I did to please him.

So you have changed in "strength" but you are still unwilling to pay your debts? Excellent example to the children. A few pounds a week is not going to cause you hardship.
