5pm - can you get a refund?

I purchased a hotel deal on the 5pm website to give to someone as a Xmas present and the person who I gave it to could not get a date in which to redeem the offer. I am looking to get a refund and the hotel in question have told me to speak to 5pm but according to the terms and conditions on their website, the contract is with the hotel and they should arrange the refund. Has anyone experienced this problem before and does anyone have any advice?
