    I would like to find out what the implications would be if this named driver broke the law whilst driving my van and had an accident in which someone was injured, invalidating the insurance. Say, they had been drinking, or speeding, or using a mobile whilst driving.

    It doesn't work like that.

    The insurance covers the driver against their legal liabilities and will only pay out if the driver is at fault. If the driver is totally blameless, the insurer won't pay out to third parties (even if, for example, someone is killed in an accident caused by the driver having a heart attack).

    So they can't invalidate the insurance or refuse to pay out or try to claim their costs back from the policyholder just because the driver has made a mistake which caused the accident; otherwise they would never pay out anything.

    Just make sure you have correctly answered all questions on the proposal and declared everything relevant.

    They can in certain circumstances, drink driving is one where insurers are increasingly saying they wont provide cover for but more commonly it would be things like the ND having told him that he had a full clean license but it transpires they actually have lost their license due to driving without insurance conviction etc
