To cut an extremely long story short, I successfully reclaimed PPI from First Plus from 11 years ago. I had Belmont Thornton representing me and it was unsuccessful and went all the way to the FOS and wasn't upheld. I cancelled their representation (last April) and then restarted the claim by myself via the Underwriters and this was successful. However, due to the poor administration at First Plus, the offer letter was also sent to Belmont Thornton. Therefore, they are trying to claim their fee. I raised an official complaint with them back in October, to which they didn't respond. Therefore, I took it to the Ministry of Justice, who have been dealing with it ever since. However, Belmont Thornton still kept billing me and I eventually got them to freeze their bills. I spoke to the MOJ last week and my complaint is still open with no satisfactory outcome yet. BUT in the meantime, Belmont Thornton have unfreezed my bills and sent it to a debt collection company (WITH NO WARNING WHATSOEVER - THEY DIDN'T EVEN TELL ME THAT THEY HAD UNFROZEN THE ACCOUNT), and have added on £550 in charges. I contacted the debt collection company last week (DANIELS SILVERMAN) and they told me not to worry and they would get to the bottom of it for me. THEN tonight I have received a letter from Daniels Silverman saying that Belmont Thornton have addressed all the issues raised (to date I have still had silence from them) and that the MOJ are no longer dealing with this account. THIS IS LIES!!! I now can do nothing until Monday morning. PLEASE PLEASE PLEASE CAN SOMEONE ADVISE ME WHAT ELSE I CAN DO!!!!! I cannot afford an extra £550 (I have had the foresight to keep the money to pay the original £4000 bill in case I lost) Please anyone?

They can huff and puff as much as they like but the only way they can take any action against you is via the small claims court. That would be held in your local court. The judge would look at both sides and decide from there. Given that there is a formal complaint with the MoJ about them outstanding and if you can get confirmation of that in writing if you have not had it already, then no judge is going to rule in their favour.
Make sure you audit trail is solid. Let the MoJ know that you are being intimidated by Belmont Thornton and their debt collectors.I am an Independent Financial Adviser (IFA). You may have grounds for a further complaint against First Plus for a breach of Data Protection.0
