....... the Police decided after speaking to me on the scene not to pursue charges for the out-of-date certificate.

    Well done.

(Care to share your (exact) words ............for future use if necessary!!)
  • There are plenty issues which could cause an MOT failure that an insurance engineer's inspection is likely to miss (emissions for one).

If you think a claim handler's going to pick up an MOT cert, see the expiry date is the same as the accident date, and sees no potential relevance in it...you're wrong.

And what's the problem with letting the OP know (his question over the validity of the cert having already been answered) that it might result in a few questions, or the claim taking a bit longer?

    Because you are trolling.

The OP had a valid MOT, a car that was roadworthy and as I pointed out in my post you don't always have to book an MOT appointment to get it on the day.

Also insurance companies can decide to take a long time sorting out your claim, like my last one did last year, because they feel like it even though your claim is non-fault with evidence.
    I'm not cynical I'm realistic :p

Just wondering if anyone knows whether my MOT expiration will affect my claim - the date of expiry was 19th Feb and the accident happened (total loss - no injuries - due to icy conditions so noone at fault) at 1.30 am ON 19th Feb - will my insurance still be valid?

The car had been fully serviced and prepped for MOT by a local garage a few days before so we were just waiting for an appointment but not intending to drive once the MOT cert ran out! Ironic or what? Now I'm not sure if the expiry date means the car was still covered by the MOT cert UNTIL 19th or whether it was in fact out of MOT on the 19th.

Any advice would be greatly appreciated!
    Thanks

I don’t keep a car long enough to require an MoT (SC is OH’s), however the insurance will be valid as MoT was at this time.

They will try to fob you off with the ‘low value’. The minimum it would be advisable to accept would be trade-in value, preferably more.

People are making too many accusations of trolling recently...
He is not "trolling", he is making points that you don't agree with. There's a difference.

I agree with him, the OP should be aware, that an insurer is likely to raise eyebrows at the fact the car was written off in a fault accident, the same day the MoT expired. Some people still, torch or damage a vehicle, if expensive repairs are needed, even though it often doesn't make sense financially in the long run with increased premiums etc.

As for the OP, the MoT is still valid for that day, and should make no difference to the claim once it is investigated and settled, but the investigation may be a bit more thorough than usual...

This thread has turned a bit silly. These two statements are not mutually exclusive:

    (i) The insurer cannot refuse the claim purely on the basis of the expired MOT; however, they can refuse the claim if the vehicle was unroadworthy and this caused or contributed to the loss

(ii) The expired MOT certificate can be a fraud indicator; among dozens of other such indicators.

The Insurer could check the MOT database to see if another test has been carried out since the one which expired on the day of the accident.

By keying the certificate number, it tells if there are subsequent tests.

I know the original certificate remains valid, however this check may indicate possible road-worthinesss issues if the later test was failed.
