car accident claim

Just dont think it is fair!

Our car has just been written off and amount has been paid to finance company.Accident was not our fault and we are left without a car and still have to pay the outstanding amount to finance company!

    It is fair.

    you don't own the car, they do. You also have an agreement to pay them the loan on it.

    I suspect you'd have been offered gap insurance yes? That's what it is for, covering the 'gap' between the amount owed and the cars current value.

    So, fair, yes. does that make it any better? Of course not but you seem to be ok so be thankful for that if nothing else.

    is there no way to claim that money back if it is a no fault accident, i.e. pursue the third party insurers to cover your uninsured losses as you would with an excess??
