Refusing to provide credit agreement.

I have just started the process of reclaiming mis-solp ppi and have hit my first hurdle! I have written to capital one bank to request a copy of my credit agreement. they have written back (after a month!!) to say that as i closed my account with a reduced settlement figure then they are not obliged to privide me with this. they say that "there is no sum which is, or will, or may become payable under the credit agreement" then the consumer credit act does not apply. Help!!!!

    You have sent the wrong letter. They are correct in their response as S78 only applies to debts outstanding or credit accounts still open. You should have sent the £10 DSAR letter not the £1 S78 letter.

    However, you do not need a copy of your agreement to make a complaint. So, unless you are going on a fishing expedition, just make your complaint.
