Barclaycard saga...please advise!!

Hi,

It is a bit of a long story so please bare with me and I would be grateful for your thoughts.

I complained to Barclaycard last June and in October had a reply to say it had been upheld,but they did not have any details of the amount of PPI I had paid so were prepared to offer me £500.At this stage they also said I couldn't take it to FOS as account opened before FOS jurisdiction. They did say that if I had any further info they would gladly recalculate a 'fair redress'.
Well I did have some statements so I checked and they said yes send them in and that is all they need.I faxed them over and between then and January I rang every couple of weeks or so and kept being told it was with the re-work team and I just had to wait.
I got fed up in January and e-mailed the CEO. Got an e-mail back from the Directors office saying they would look into it.
After a couple more phone calls I was advised by them to complain about the length of time it was taking to resolve the complaint and they are dealing with this as a seperate matter but I did say that I didn't want to complain if it jepordised my PPI complaint,but was assured it wouldn't.

Now the PPI team have sent me a letter to say they have reviewed my complaint and are now NOT upholding, but I can still have the £500 as a gesture of goodwill or I can take to the FOS if I want (as they had obviously lied before when they said I couldn't!)
They have sent me a 5 page letter which basically quotes my e-mail to the CEO......but no answers to my questions and all the info from my questionnaire.

They are now saying that as I ticked the yes to PPI box& signed the postal application I knew what I was doing and wanted the PPI.They say it was a non advised sale.

My reasons for complaint were that it was one of those 'guaranteed acceptance' type applications which required very little completion,did not make clear the PPI was optional and had I known I wouldn't have agreed to it as I had no need due to being employed as a civil servant (good sick pay,death in service,little chance of being made redundant etc) and pre-exsisting health issues.

So what do I do now? Do I have any chance with the FOS or should I accept the £500 and forget about it?

So annoyed and upset at the shoddy way they have dealt with this....it's been constant lies from them and I really don't want them to get away with it but at the same time can't afford to loose £500!

PLease help...what do you think?

    Simple answer FOS it, you are going to get nowhere with Barclaycard, they are great at fobbing you off and offering very low gestures in the hope you accept or give up. If you do FOS it, it will cost Barclaycard what they are offering you, they are calling your bluff. Time to call theirs ;)

  • Very interesting.. apart from the original offer i too see to have had a simular problem with Barclaycard, totally fobbed off i felt, anyway complaint in with FOS now.Thought barclaycard's rejection letter was total B** crap!!

    That is a valid response.

    If the box was pre-ticked (or tick to not have it) then the FOS do not like those. If you ticked the box then you are scuppered.

    Which was it?

    Remember that there is nothing wrong with having PPI. The issue is about how it was sold or set up. You were not sold it. You bought it. So, you were not mis-sold. It sounds more like mis-bought. You are purely reliant on whether the tick box was pre-ticked or not.

    I am waiting to receive the copy of the agreement that Barclaycard are suppossed to be sending me and then I suppose I will have to decide which way to go with this.
    I don't think I did tick the PPI box as I had no need of it but if the box shows as ticked I suppose I cant prove otherwise.....still fuming that this was upheld 6 months ago and now I'm back to square one!!

    Fifi, I totally agree with your thoughts about the rejection letter...pages of irrelevent info that to me read like it had been written by someone new to the job who didn't understand what he was writing,just using a 'copy and paste' template.
    Really annoying as well that it's impossible to actually speak with any one on the PPI department.

    There is nothing to indicate that the FSA regulated complaints process is not being followed. Indeed, if anything, far too many consumers are being paid out than they should be as a number of firms have introduced auto payouts on amounts below a defined floor limit whether or not the complaint is valid or not. What is it that you think is not being followed?

    The only issue on PPI seems to be that some providers are lagging on dealing with the payments due to backlog. This will be given a little scope as long as improvement is seen.

    I don't agree with your response. My BARCLAYCARD account was sold to me on the station concorse at Glasgow Queen Street BR station by a salesperson with a clip board.

    That was in the 90's.

    The application form the salesperson with the clipboard completed may well differ from the conversation that took place between us in those 6 or so minutes as I was not party to what was recorded.

    Like I say, that was the 90's and Barclaycards sales channels then were different.

    Please can you Pm as i too am having a nightmare regarding my Barclaycard/loan ppi complaint, i have been waiting months and months for a reply, since then i have sent another letter and have still not recieved a reply, im very disapointed in the way i am being treated, i feel my case is just being ignored!
