Hi Guys,

I have been getting Martins weekly email for past few years so I thought this is the best place to inform the community about this issue I had with Comet. I hope martin can let everyone know about this as its our legal right to get a replacement laptop if it was faulty at the time of purchase.

I brought a laptop from Comet in April 2008. After 3+ years the screen kept on going blank and laptop overheating. Whilst I was looking for a repair I was pointed to this site nvidiadefect.com. I learnt that the Nvidia GPU chip in my laptop was inherently defect and I had 6 years to claim for it under sales of good act.

I wrote to comet in september 2011, and they fobbed me off saying it was out of warranty.

I then got an external engineers report and proved it to them. They still refused. I put a small claims in via the court against comet. 2 weeks ago comet offered to settle out of court, and gave me a new laptop, and paid for all my court costs and engineers report.

I just got my new laptop yesterday.

I wanted to publise this to all because if you have similar problems, then you have rights under law to claim. Its very easy and the site helps you all the way.

The problem is widespread, effecting all makes of laptop, just search on google for nvidia deffect.
I am so surprised why mainstream media are not publicising this more.

This is for everything a consumer can purchase under the Sales Of Goods Act not just laptops with nvidia components.

Hardly newsworthy - you can read it in the FAQ and 95% of posts on this forum.

How will I find out the same thing for Whirlpool washing machines as to whether they have an inherent fault pleas.

Google is your friend, normally when there is a wide spread inherent fault it will have hit the papers/ websites as the nvidia one did and so search engines help you find it.

To my knowledge Whirlpool washing machines were never fitted with NVIDA graphic chipsets. I suspect they were some ATI Radeon type. Maybe worth reinstalling / updating the the drivers from the manufacturers website, or using an alternative detergent.

Whilst this is a good indication of what the fault may be, it is not evidence of the fault being present in any one device. So not the best grounds for a claim against a retailer.

I think you you miss the point.... The newsworthy part is that most people are unaware of this issue. The blank screen and overheating may start playing up after 2 or even 3 years. So most people will put it to the laptop failing due to its life cycle and do nothing as its out of its 1 year warranty. Or they either pay for repair, which is impossible because all repairs to date have failed, so there is no known repair. Or they go and buy a new laptop.

Few people may contact the retailer like Comet and currys, who will fobb them off, which in my opinion is illegal, because they know there is a fault but they are advising their customers otherwise.

All I am saying is to use my case and many others from nvidiadefect.com[/url] and be persistent and get yourself a new laptop, or get refund. I spent £945 back in 2008 its a lot of money in these days of poor economic climate......

It our legal right and these retailers are denying us this. They sell faulty goods and then don't want to even admit it.

How dishonest is this that Comet had already paid out to people who had the exact same laptop as mines, but when I wrote them they fobbed me off and said its out of warranty.

Please lets get the word out so people don't be out of pocket.

Whilst I have heard of the NVIDA effect (and do not doubt that this issue has existed for some time) as it is regularly discussed here as well as the tech forum. The same applies.

You can pretty much Google anything, does not make it true in every instance.

After six months it is the consumers responsibility to evidence that the goods do not conform to contract, not the retailers.

I'm not condoning Comet's actions, however I do think you have been very lucky to have got a new laptop out of them after three years.

In promoting the awareness of the NVIDIA effect, you probably also need to manage the expectations of anyone potentially claiming for this fault under SoGA after such a long time.

But 3 years isn't such a long time though, you have up to 6 years (five in Scotland) to claim. There is little doubt an expensive laptop should last longer than 3 years.
The OP on this occasion did it by the book with the engineers report to back it up, there was only going to be one winner in this one.
This also proves the UK has a better policy than the secret EU rule.
The key thing to remember though is the need for the engineers report to back you up.

I had one of those chips installed by laser eye surgeons. I was gutted when it failed, but them, unlike comet, replaced it free of charge!!
