One way or another i have built up a lot of debt with about 8 creditors, for the past 4 years i have been paying them token sums slowly ( about 10 pounds etcetra)
All are in various DCA's etcetra..
I have not gone down the route of SAR etcetra but i think i want to give it a try as im sure at least 4 of the debts i took out are before 2007...
Is the instructions in this thread still valid?

I noticed the II III threads have the updated letters missing and the final posts are missing altogether.
Hope you can help as i dont want to send a SAR? if there is no point..

You cannot get your debts cancelled.
If your debts are debts that are covered by the consumer credit act then you can request a CCA - a copy of your credit agreement for them from the debt collector.
If they don't supply you with one then they cannot enforce the debt until they do supply one.
If they supply one and it doesn't contain all the prescribed terms then that cannot enforce the debt .
If they cannot locate the original document they are allowed to supply a reconstituted version of the credit agreement - which must be the same as the one you would have signed. (this bit is likely different to what is in that thread).
By not being able to enforce the debt, that means they cannot take you to court and get a judgement against you (or if they tried you would defend against it).
But they would still be able to chase you for the money, you would still owe the money and they could still report to the credit reference agencies (though at a guess your credit files already show defaults for the debts and so they couldn't make them look worse really).A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
