Primus Contract Advice

Can anybody help me out please?

I signed up for a 12 month contract with Primus Saver (New Call Telecom Ltd). After 6 months I moved house and requested that they disconnect my phone. I understood that I would have to pay the remaining 6 months of line rental and had no issue with that.

However, they disconnected my phone 3 days earlier than I asked them to. At this point I called and disputed the fact that I had to pay the remaining 6 months of my contract, as they had ended it earlier than I wanted. The person I spoke to told me that they needed to speak to somebody else and that they would get back to me. I gave them my new address and mobile phone number, and left it at that.

I heard nothing from them for a few months and then received 4 letters that had been sent to me at my old address, all demanding payment.

I have now spoke to them regarding the fact that I still dispute whether or not I owe them the money, and also the fact that they have been writing to the old address for so long, therefore denying me the time to properly look into my options. But they are insisting that I did not give them my new address and that I therefore have 3 days to pay the balance before it is passed to a debt collection agency.

Can anybody advise me where I stand on this issue? Do I have to pay for the 6 months despite them cutting me off early? Do I have to pay within 3 days despite them sending letters to the wrong address?

    You might be able to extract some minor credit from them for cutting you off before the agreed date. But 3 days? That does not void the minimum term of 12m that you agreed to.
    You don't have to pay in 3 days-but since they will otherwise pass the debt onto a DCA and potentially trash your credit record for the next 6 years, is it really worth the hassle?
    No free lunch, and no free laptop ;)
  • You're right about the credit issues. And I will probably just bite the bullet and make the payment.

    But it doesn't seem right to me that they can cut me off early (I still needed the phone line and had to ask neighbours to let me use their broadband) and still demand full payment. Especially as they haven't even managed to send the demands for payment to the correct address.

    Incompetent, yes-but it doesn't give you a get-out clause.
    If they charged you for those 3 days, you're entitled to a credit-but that's about it.
    No free lunch, and no free laptop ;)
