Had just under 2 days and no response so Paypal dispute opened. :(

Usually when you don't hear from them, they soon reply when you open a dispute. I would wait 24 hours then escalate the dispute to a claim and let Paypal deal with it.

You will need to send the item back tracked - Hermes or Collect+ might be a cheaper option than RM, depending on size & weight so worth looking in to.

Is the seller a private seller or business seller?

Private seller, ParcelForce 48 was cheapest option, too big for Collect+. If you read my OP he has the item back already and has agreed it is damaged.

I read it yesterday when I posted but forgot you mentioned that you had already posted it back tracked.

I would escalate the dispute to a claim now and enter the return tracking number, there is no reason why you should wait any longer.

Left it at dispute, got a response this morning so a shot across the bows worked ;)
Through ebay messaging though, not replied through paypal.

Return postage has been paid as a transfer to my paypal account and a refund for item & postage is showing in my account pending until 2nd March, I assume that will be credited back to my CC.

Yes it will go onto your CC & can take 30 days to show on your CC statement. It could be showing as pending as the seller had transferred the money to their bank account & it now has to be transferred back into Paypal, that part takes about a week.
Rather an expensive way of doing it for the seller, I've only had 1 item broken in the post & refunded on receipt of photos of the damage.
At least he did the decent thing & refunded the return p&p, hope you hadn't already left a neg.

No I hadn't. I will leave it until I have all the money back in my hands and give a positive as I do believe it was damaged by the couriers.
