Can I move out?

Hi,

I recently moved into a flat. I stupidly signed a 6 month tenancy agreement because I was told that after 2 weeks I can change my mind. I am now being told this is not the case.

The area in which i live is really rough and I feel like a prisoner in my own home. I viewed it on a sunday afternoon and it was quiet and seemed pleasent, I was homeless and the landlord told me if i signed i could still change my mind if i let him know within 2 weeks.

I want out, what can I do? :( I know I have made a stupid error and don't need reminding. the notice period is one month. I signed last sunday.

  • Who's notice period is one month? At what point during the tenancy?

I think you're stuck there for 6 months I'm afraid but I reckon you'll get used to the area after a while. Lighter evenings will help.

Do you have anything in writing that confirms being able to change your mind after 2 weeks? If not then unless you can appeal to your LL's good nature, you will need to see out the remainder of your lease unless you want to risk losing your deposit and beign taken to court.

DBM is right, you will feel better once the lighter evenings come in and you get used to the place a little more. If you didn't notice how rough it was in the first place, it really can't be that much worse, can it?
  • Do you have the landlord's 'cooling off' period in writing? If so, move if not, make the best of it. It might be better than being homeless, and is a base to look elsewhere. Keep a diary of any problems, in case you wish to be housed again. Good luck - I hope it's better than you think.

If the contract is 6 months, it is unlikely you can give a months notice - what does the contract say?

Unless you have something in witing about the 2 week 'trial' period, you will have to rely on your LL's good nature.

Offer to pay his expenses for re-advertising and finding a new tenant, and to pay rent till a new tenant is found.
