Whilst preparing pancakes for tea tonight I had a call from TopQuote to ask if I meant to cancel my Life Assurance policy with them, " Yes, as I have managed to get it less than half the premium per month (thanks to this site) for more cover" and I have already contacted L&G and they are happy to cancel.

He then gleefully informed me that I signed a contract to stay with them for 4 years and I owe them £250!!!

I'm so mad as that was in May 2010, I'd been with TopQuote for my previous life assurance with Zurich for years and out of the blue they phoned to say L&G would be better and they'll send round their insurance guy to get the docs signed, stupidly I made him a cup of tea and whilst he was telling me about his car woes, just signed it....Just assuming it was a company hand over for them, when in reality they would now earn more commission....

I think I will have to pay this twice as my husband also had a policy too, but I really feel I was mis sold the second insurance, the man at Top Quote argued that they don't give financial advice and I had 30days to cancel, but they contacted me when I was perfectly happy with my original level term assurance and he said this policy was better as they didn't really deal with Zurich now...

Yes I'm an idiot (to the tune of £500 now), but so mad at my past self, if anyone has any advice (positive) I need some right now :o

    Check their ts + cs and see if they are charging you in line with them before paying the bill!

    If its the topquote i think it is, i know them quite well.

    However, this is part of the issue of not using an advisor - they do not give advice, so you cant claim it was miss sold. They basically tell you what life insurance is and ask how much you want.

    They will take you to court for loss of earnings. To be honest as far as im aware they always win.

    I'm struggling to see how cold calling the OP to tell them there was a "better" policy available can be anything other than advice in the normal sense of the word

    I agree, but unless the call was recorded - which there is a good chance it could have been. Its very difficult to prove one way or the other. The company as far as im aware though do not offer advice so if that was said, its classed as advice and is obviously in breach of what they can do.

    Sounds like a case for Dunstonh and Magpiecottage to get their teeth into.

    yep, but knowledgeable as Dunstonh and Magpiecottage are I suspect in terms of getting the OP her money back a better solution will be to suggest to TopQuote that if they don't play ball then perhaps the FOS/FSA should be asked to decide whether the conduct amounts to advice

    They've helped a few mse members in a similar situation out before before but it does depend on certain information
