Help!! dampness in new property

We moved into a new property April last year since then we have had problems with dampness in the living room and bedroom. We were meant to move into the flat Dec 2005 but there was a fire and we now think this is the reason for the dampness in the wall there is still water retention due to putting out fire. The company who built the properties have off the record told us we should sell or request being rehoused by the developer (George Wimpey). Any advise would be welcome should we get an independent surveryor out?
The property is guaranteed for 2 years

  • Do you not have an NHBC 10 year guarentee as well?
    I'd imagine it would be up to them to prove that the dampness was caused by extinguishing the flames.

    You should contact the developer and report it as a defect. They have to address and sort the issue as its within the first two years defect and snagging period. If they do not address the problem or acknowledge it go to the NHBC/Zurich or whoever provided your new build guarantee, who will (or should) force to Developer to sort out. If the problem isnt reported to the developer within the two years you will have a right on your hands to get it sorted. Do not attempt to sort out the problem yourself or you will invalidate the developers guarentee.
