Student Loan arrears, let them take me to court?

Last year I was a few months late in deferring my student loans because my mother got very ill and died. It was very traumatic and i was put on ant-depressants. At the time i also wasn't working.

I hoped the Student Loans Company would understand the reasons why i was late in my deferrment.

Instead, they `passed it on' to a company called NCO Europe who are demanding £500 off me.

I am not working again, and think the whole thing absolutely stinks. I am considering letting them take me to court over it because I don't think i should have to pay bck the arrears considering my circumstances at the time.

What do people think?
HSBC overdraft: £1300 approx

Barclaycard: £200 aaprox

Captal One card: £300 approx

Student Loan: £5000 approx

Student loan arrears: £500

All debts are going down except Student Loan.:rolleyes:

    I think letting them take you to court would probably be traumatic for you at the moment.

    Have you been able to speak to someone at the Student Loans Company to explain your situation? If not, what about the Citizens Advice Bureau? I think it's important to talk it through with someone face to face who can give you good advice.

    I was in a similar situation as I left uni to care for my sister when she was terminally ill. I was in no fit state to defer either. My advice is write them a letter asking to defer NOW so that whatever you decide to do about the past, you are not accruing more and more debt. Unfortunately I didn´t do that early enough and if you are (as they see it) in ´breach of contract´ then the interest just piles on. There are lots of battles worth fighting and I would love to know that you win but I put a lot of energy into fighting my case and got no-where. I think the biggest problem is that I used the phone a lot and didn´t take it to my MP. The people in the call centre don´t have the power to help you and will just fobb you off.
    Some of them are caring but at the end of the day, they just can´t help. My advice to you is don´t let it get out of hand. It could spiral into heaps of debt as mine did.
