Please help me end my claim hell!

I don't appear to be getting anywhere with this, having spent an hour on the phone to the police and SC yesterday, I'm having to go down the Motor Insurers Bureau route and attempt to get something off them on the advice of the lady at the police station. Why SC never mentioned this before is quite beyond me as we've exhausted all leads to this guy and it appears he's disappeared without a trace. Also worth noting that he's been done for causing an accident without insurance before, according to persons known to him. Swine. :mad:0

If everyone you've spoken to thus far is being difficult I'd see a no win no fee solicitor. If he was uninsured it would be a different kettle of fish and you'd need to go down the MIB route, but he has a valid insurance policy so there is someone to get money off, even if he has disappeared. Hope that makes sense - I think the procedure is to jointly sue him and Co Op insurance for your losses.0

If you are claiming off your loss from 3rd party's insurer, you pay no excess.
If you are claiming off your own damage from your insurer, you will have to pay excess. Then your insurer will claim that from 3rd party's insurer and then you get your excess back. If your insurer can't claim that back from other insurer, you won't get your excess back.Happiness is buying an item and then not checking its price after a month to discover it was reduced further.0 -
            It doesn't work that way.
The excess is just that.
It's just the first part of the claim you pay, if the claim is less than the excess, you don't top it up.
Technically that's not true. Obviously in situations where your excess is higher than your claim payout it would make sense to cancel the claim, but if you pursue it you would need to pay your full excess, even if the cost of the claim works out as less.
Similarly though, most insurances will offer you the option of reimbursing them for the cost of the claim and they will change it to non-fault on the exchange.0 -
With regards to the claim itself it shouldn't be an issue unless the third party is claiming the incident never occurred. In which case it may be beneficial to contact his insurance directly as, as far as I can see your insurance company are not doing anything 'wrong' as such. If they're refusing to pursue it i'd ask for justification of this as even the most flimsy of accusations needs to be properly investigated.
A warning though, claims like this tend to go on for many months, sometimes years and you'll only be reimbursed your excess if/when it gets closed in your favour.0 -
Even worse news is that as it stands your insurance policy is now fully paid out and so cover ends immediately when you accept.
Ok, not too bad if you've run the car for nearly a year but I've heard of folks having 1 weeks use then having to renew the policy after a total loss claim. Sometimes gets forgotten.;)I like the thanks button, but ,please, an I agree button.
Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)
Always expect the unexpected:eek:and then you won't be dissapointed0
