Hi there,
My husband is being pursued by Lowells debt recovery for @£7000 debt to a credit card. So far, they have just sent a letter every few weeks asking hubby to contact them to discuss the debt which he hasn't. Today he received a letter telling him that they had checked his credit file and that he was making other payments to banks etc (this part was very vague) so that they would be pursuing him for the debt and that he must contact them.
My husband is pretty sure that the original debt is more than 6 years old and that he hasn't paid anything in years. What does he need to do to find out if the debt was last acknowledged / paid more than 6 years ago so that it would then be statute barred?
Any advice gratefully received thanks in advance!!

Usually its down to a person to check their own records (old bank statements etc to find out when a payment was last made) any letters sent to the creditor or debt collector and check the dates on those etc.
Can he not check back to see?A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
The easy way to deal with Lowells is to simply ignore them. Never contact a debt collector, they will go away if they don't have any way of knowing if you are getting the post or not.
I got a few letters and texts from Lowells last year, ignored them, never heard any more from them.
BTW if you allege that the debt is statute barred it is then up to the other side to prove it isn't. But if you don't speak to them the subject won't come up, will it?
Ought to add Lowell's are a "debt-purchasing" company, i.e. they buy the rights to the debt, they don't collect it on behalf of the original creditor. Hence, if you pay them anything, not a penny will go to those that lent you the money, all of it will go to the greedy parasite called Lowells. Remember that in case you feel morally obliged to pay.0 -
Thanks for the good advice, so far they haven't threatened anything, just the usual "you need to contact us"etc. We will just continue to ignore them!!!
thanks again0
