Redundancy having gone part time for only 6 months

Hi, I wonder if anyone can help me.

My sister went part time (20 hrs per week) only about 5 months ago, having been full time for 12 yrs. The company has now decided to 'restructure' just her team at work and the roles available are only full time ( they also have too many people for the roles available).

She originally requested part time to give more time to build up her own business (hypnotherapy/counselling) so, assuming she got the role, going full time would not work with this, plus these 'new' roles have lots of other things packed in to them now too.

She's decided she will take redundancy but - I wanted to know whether she'd have any right to appeal the fact that, having gone part time very recently, her redundancy is half what it would have been if she was still full time?

thanks Margie

She can try, depends if the company show a bit of simpathy

Statutory is capped at £430 per week pays so it might not be 1/2 if she was paid more than £430 full time..

Redundancy pay is calculated on the average weekly pay over the last 12 weeks, capped at £430. That is the law and there would be no right of appeal.

    Is that the legal minimum?

Many companies do offer redundancy terms greater than the statuary minimum, just as many pay higher than the minimum wage.

She needs to get the terms of the package from the HR dept.
