Cancelling contract with weatherseal

I've made a massive mistake and need advise. I had them out Fri eve at 6pm didn't leave till 11pm after a huge amount of product advertising, I eventually agreed to what sounded like a great idea at the time. Since having a good sleep and reality his hit I really do not want to get myself into this kind of debt. I did read the contract but was so sure I wanted these windows and doors it didn't matter at the time.

Here's the cancellation part I'm concerned about ....If you withdraw you must pay us the amount of credit plus daily interest from the advanced date till we receive the sum :eek: Is it not right under scottish law I have 14 days to cancel any credit agreement, there is also a cooling off period if you change your mind? Surely I will not be expected to pay anything towards this considering the business is shut all weekend if I get them 1st thing nothing will go through?? I have noticed that on the order/contract slip there are errors such as I asked for silver and she's written gold, the door that I ordered was confirmed as not avail to me by the surveyor, another thing is it is not signed from their end - signed for and on behalf of barclays partner finance is blank I'm proberly clutching at straws but does any of this make a diff? Thankyou

    2 different regulations here.

    Cancellation of Contracts made in a Consumer's Home or Place of Work etc Regulations 2008 give you a 7 day cooling off period to cancel the contract for the windows.

    The Consumer Credit Directive changed the Consumer Credit Act 1974 to give you a 14 day cooling off period for the credit agreement.

    Write them a letter stating you wish to cancel.

    I wouldnt worry. But do it in writing, keep a copy. send a hard copy in the mail recorded deliever, email also ask for confirmation that they have received the cancellation.

    I cancelled a contract for DG within 7 days, they gave me the names of 2 people who they had put windows in for and when we went to see them the householders said they wish they had never set eyes on them and they advised me not to touch them with a bargepole.

    Order Cancelled.

    As the other poster has indicated, there are 2 cancellation periods. one if for the whoel ocntract and oen is for the credit.

    the contract should have a slip that you can tear off and send in to casncel - alternativley you can write them a letter -send it recorded and keep a copy.

    Remember to follow the cancellation process for BOTH the sale and credit. If you cancel the credit alone then you're merely cancelling the form of payment and could find them trying to get you to pay the balance via other means - by which point if you cancel could be liable for their provable losses

    With Weatherseal I would definitely send the cancellation recorded delivery. It is taken to have been served (notice of cancellation) the date you post it.

    However they have been notorious in the past and I believe were featured on reps from hell.

  • Thankyou very much for your replies. Got confirmation of cancelled contract today.

    For anyone having same issue......
    I sent a recorded delivery letter and email to both Weatherseal and the fitter company advising cancellation last night. I called Barclays and they explained Weatherseal have to cancel the contract with them this is normally done via email upon receiving my email/letter - which I'm told has been sent by rep who just left, no further action required. No funds are released from the credit agreement until Weatherseal fit your windows.
