no to ESA benefit

been on incapacity benefit for 15 + years now removed to ESA I have had depression for over 35 years so i am not fit to work but they say differently. what happens if i decide to stop taking ESA what benefits am i entitled to if any the stress is pushing me to my limit.
any help :)very much appreciated

    There are no income replacement benefits other than ESA.
    You may if you are eligible claim DLA.

    You can also appeal your ESA decision.
  • If you do not wish to appeal the ESA decision you would need to claim JSA and seek work. Do you receive DLA, does anyone claim Carers Allowance for you? You could still claim HB and CTB on the basis of being on a low income.
  • Yes... as above.. might be worth thinking about appealing. Look at the descriptors for ESA's two main phase groups WRAG and Support Group and figure out if you think you qualify for the benefit. If you think you do then I'd recommend requesting statement of reasons for decision (if not already supplied) and copy of all evidence they've used for it and appealing. There are time limits so make sure you don't fall foul of them. Try to get any medical evidence you can that is supportive of your claim (especially if it relates to information relevant to the descriptors). If you appeal they will first do an automatic reconsideration. You should should able to get ESA at assessment rate if you appeal and are able to get the cover of 'sicknotes' from doctor. The success rate of appealling is significant but it can take many months.

    Without sounding harsh, 1 hour out of a two week stint for a benefit does not seem too stressful?

    Try working 60 hours a week!

    If you've had depression for over 35 years, have you considered taking a small part time job that might enlighten your day?

    Sorry to hear about your benefit troubles, but seriously you need to take an alternative view on life.
    Be happy, it's the greatest wealth :)
