RBS have settled PPI - but money has disappeared!

Hi all

sorry it has been a while - we are now faced with a new problem.

After winning 3 ppi mis-sell cases with NAtwest (RBS) last year, 3 letters were sent dated 23rd December to say that the various refunds had been passed to their Credit Management Unit (including ppi installments, and interest which I thought they had to pay direct?).

My OH makes payments to Shoosmiths (Natwest Solicitors) every month. To date (nearly 2 months after apparently paying out), Natwest's payment has not been received by Shoosmiths. Natwest PPI team won't speak to us, and Shoosmiths are apparently "chasing" for an answer but even though we have called weekly since the start of January they are no nearer getting an answer. I have scanned in the letters and emailed them over so they have all the details.

We are therefore still having to make payments on this loan (even though the refund should wipe it out with some to spare), which is causing difficulties.

Any suggestions about what to do next? If the Ombudsman is the answer, are we going to have to wait a year for them to look at the case?

  • Not to mention of course, that the interest was paid at 23rd December 2011 and we are now 2 months down the line with no interest being earned/paid
  • Just an update - if anyone is interested.

    Natwest had passed the debt to Triton Credit Services (their own credit management arm) with payments being made via Shoosmiths - Natwest solicitors.

    Natwest won't speak to us other than the claim has been settled in December, Shoosmiths say they have had nothing through to tell them payment has been made.

    We finally spoke to someone in Triton on Friday who advised that the money is with them (including the interest amounts), and they have at least a 3 month backlog in passing it through to Shoosmiths. At the point they do - they will refund the interest that Natwest paid to my OH by cheque. No interest however will be paid for the 3 months they have sat on it, or the potential interest lost to us in having to continue to pay the debt.

    Well here we are some 3 months later and still no joy. Called the ombudsman last week and he is progressing it for us.

    Seems the money is sitting with triton credit management (part of rbs) who are not passing it to shoosmiths.

    But the reason for my post is to say that triton have sent a letter now stating that there is £6000 to pay! We have been paying shoosmiths for 5 years with annual statements stating the debt is reducing to currently around £900 which the ppi refund should clear.

    My oh has no paperwork on the loan and we have never received any statements from natwest or triton in all this time, just shoosmiths. The account number is the same - can anyone tell me if they are allowed to do this, we were so so close to being debt free and this has come as a dreadful shock. I haven't called them yet but even on the phone in january they confirmed the same amount shoosmiths have been telling us all these years. What are my oh's rights to fair information?

    Sorry to hear this and i am even more sorry that nobody has answered any of your posts!!.

    If your Hubby has statements showing what the balance is then you are covered, they cannot increase this debt if you have proof of what is owed.
    Is it possible that Triton have not got up to date paperwork?, I hope this is the case.

    What do the FOS say to this fiasco? they should get their finger out and get this loan cleared with the redress.

    I do not know what to suggest you do at this moment, i wish i could point you in the right direction, maybe a complaint to Triton about this matter and perhaps get the FOS to hurry up with this as it is causing you hardship, paying a loan that has PPI on that has been redressed is disgusting.
