Claiming against o2 under Supply of Goods and Services for 19 month old iPhone?

Yeah, and talking from extensive experience, you'll a) need it and b) regret ever buying an HTC when you have to use the 'warranty'.
My son purchased a HTC Desire last year, when the screen failed in October last year he contacted HTC.
Monday morning UPS arrived and collected the phone, Thursday afternoon UPS arrived and returned the fixed phone.
Can't fault HTC repairs whatsoever.0 -

I've not had any problems despite buying HTC for the past 7 yrs. I did get a (hardware qwerty) keyboard replaced on a 23-month old phone when it got a bit sticky and got the phone back working properly again within a week. If the other option is for the manufacturer to abandon me halfway into my contract, I'll take the 24months with gratitude. Horses for courses, maybe I am luckier than you are ;-)0 -

Indeed personal experience is different - mine was based on 4 phones and 6 repairs.
iPhone has a 12 month warranty, but it also has a walk out replaced there and then warranty - and a 12 month extension is £60.
Not to be sniffed at to be honest...but as we all say, its personal experiences...0 -

Have to say, credit to HTC for fixing it as well because it turned out the screen had gone faulty because the battery had 'swelled' with heat in the back. As it was a replacement longer life battery and not an official HTC one I was expecting them to say 'tough'.
Still prefer my iPhone though
My worst repair experience was with Samsung who, to put it bluntly, pished about for 2 weeks over OH's Galaxy S I, promising to send return envelopes which never arrived etc. Real pain to get that one sorted.0 -
They may not have sold a phone, but they did supply one.
IMO, this wouldn't be any different to someone who buys an expensive item and gets a freebie as part of the deal. Even though they didn't pay for the freebie, it still forms part of the contract, especially if this "gift" is needed for the paid for service to be used as in the case of a mobile phone contract.
If o2 tried to use the argument that they hadn't sold a phone, does this mean that if someone took out a contract which they cancelled within the allowable period, they wouldn't need to return that phone?
(This is all my unlegally trained opinion of course)0 -
I would argue that the case could be made that they haven't sold you a phone.
Didn't you do the Consumer Rights quiz on here a few weeks back?
Anything supplied is part of the contract price, or when you get a BoGoF at a supermarket, would you accept a tin of beans that are tasty and edible, but another tin that taste of crap, are mouldy and skanky? They only sold you one tin?

They haven't sold you a phone outright if your argument is correct then you have bought the phone on HP or similar.
Your tins of beans argument is nowhere close to this scenario.
