Well I have applied for the set aside, so I will firstly see if that has been accepted or not, and will keep the thread updated.
Just one thing....
The hearing was held on 13/02/12, and the courts are stating that payment needs to be made by 27/02/12. Is this normal? I thought you have 1 month to pay?0 -
Lets also not forget that we don't have the other sides witness statement - it's amazing how different a story based on the same facts can be told.. you know that
Yep, even different stories from the same litigant....gavandcarly wrote: »will keep the thread updated.
Pls do!gavandcarly wrote: »The hearing was held on 13/02/12, and the courts are stating that payment needs to be made by 27/02/12. Is this normal? I thought you have 1 month to pay?
The 1 month thing is the time before the CCJ is recorded by CRAs.0 -
Ok so what happens if I don't pay the full amount by 27/02/12 which is today?
Surely that isn't enough time to allow someone to pay.... That's only 14 days....0 -
The court gives 14 days inititally for the CCJ to be paid. After that the creditor can choose to take enforcement action. The courts believe 14days is sufficent for someone to pay a CCJ, or to ask for a redetermination.
As discussed earlier on the thread in practice for her to take enforcement action is going to be pretty difficult considering you live abroad and don't have assets in the UK.
In another 2 weeks the CCJ will be recorded on the registery trust website (which is publicly searchable by anyone) and from that site will filter to the credit reference agencies.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
Perfect,

Just a quick update.
I applied for the set aside, and I also sent copies of my outgoings and salary etc.
A set aside hearing date was set, and the set aside fee was wavered for me by the court.
I attended the set aside hearing, the claimant did not turn up.
The judge granted the set aside, and a new hearing date is going to be sent to be in the post shortly.
I am going to start preparing all of my evidence, fingers crossed I can get a fair outcome in regards to this.0 -
